November Court 1761 114 By Virtue of the foregoing Account Proven and Warrant was Issued the following Attachment Against the Goods Chattles and Credits of Henry Caulkwell Somerset fst Frederick Absolute Lord and Propry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c. To the Sheriff of Somerset County Greeting We Command You that You Attach any the Goods Chattles and Credits of Henry Calkwell Late of Somerset County Leather Breeches maker if they Shall be found in Your Bailywick to the Value of three pounds Nine Shillings Curt Money and five hundred pounds of tobacco & When you have the Same Attached or any part thereof the Same in Your Custody Safe keep so that you have the Same before our Justices of our County Court of Somerset to be held at Princes Ann Town the third Tuesday of Novr: next then and there to be Condemned According to Act of Assembly to and for the use of a Certain Levin Ballard unless the Said Henry Calkwell by himself or his Atty Shall Appear and Answer unto the Said Levin Ballard in a plea of trespass upon the Case &c. According to Law and that by Good and Lawfull Men of Your Bailywick you make known unto the person or Persons in whose hands You make the Same Attachment that he She or they be and Appear before our Justices of our County Court of Somerset to be held as afd. to Shew Cause if Any he she or they have why the Same Goods Chattles and Credits So Attached in his her or their hands Ought not to be Condemned and Execution thereof had and made According to Act of Assembly in Such Case made and Provided if to him her or them it Shall Seem meet and how you Shall Execute this Writt that you make known unto our Said Justices at the day and place afd. and have you then & there this Writt Wittness Isaac Handy Esqr. one of our Justices of our Said Court the 20th day of August Anno Dom. 1761 Att which Said third Tuesday of November Came the afd. Levin Ballard in his proper person and the Sheriff to witt John Dennis Gent now here Returned the afd. Writt of Attachment Indorsed in Manner following with a Schedule thereto Annexed Somerset fst I hereby Certifie to the Justices within named that I have Attached of the Goods and Chattles of the within Henry Calkwell the Sum of three Pounds Eleven Shillings and Six pence Curt Money as also four hundred fifty Seven and a half pounds of tobacco as by the Schedule hereto Annexed for Satisfieing the Debt herein Mentioned and I further Certifie to the Justices afd. that I on the first day of November 1761 I Attached in the hands of Robert Leatherbury fifteen Shillings also in the hands of Arnold Elzey Senr. three Shillings and in the hands of Mat. Jones twenty Seven Shillings and Wm. Jones fifteen Shillings and that I by Thomas Holbrook and John Doe Good and Lawfull men of my Bailywick I made known unto the Said Parties to be and Appear before the Justices within Named at the day and place within mentioned to Shew Cause if Any either of them have why the Severall Sums in Each of their hands Attached Should Not be Condemned for the purpose afd. Robert Leatherbury, Thomas Sloss, Wm. McClemey and John Harris So Answers J Dennis Shef.
Thereupon the Said Levin Ballard prays that upon Giveing Security According to Act of Assembly in Such Case made and Provided the Severall Goods and Chattles so as afd. Attached and Valued at three pound Eleven Shillings and Six pence and four hundred and fifty Seven and One fourth pounds of tobacco as Appears by the Appraisment afd. May be Condemned as of the Goods and Chattles of the afd. Henry Calkwell towards Satisfying unto him the Said |
