Court of Somerset Recovered Against Purnall Newbold the Sum of fifty Six pounds and Eight pence Curt Money of
Maryland and Two hundred and Seventy five pounds of tobacco whereof the Said Purnall is Convict as by the Record to
as Appears and Now on behalf of the Said Nicholas in our Court before us we have understood that altho Judgment
thereof is Given Execution Nevetheless of the Judgment afd. Yet Remains to be made to him whereof the
Said Nicholas hath besought us to Grant him his proper Remedy in this behalf and being Willing that is Just
in this Behalf Should be done Command You that by Good and Lawfull Men of Your Bailywick you Give
Notice to the Said Purnall Newbold that he be and Appear before our Justices of our County Court of Somerset
to be held at Princes Ann Town the third Tuesday of November Next to Shew Cause if he hath or Can Say
Any thing for himself why the Said Nicholas McCubbin Ought not to have Execution for the Sum of Money &
Tobacco afd. Against him the afd. Purnall According to the force form and Effect of the Recovery afd. if he Shall
think fit and further to do and Receive what our Same Court Shall then and there Consider of Concerning
him in this Behalf and have you then and there the Names of them by Whom to him you Shall Give notice
and this Writt Wittness Isaac Handy Esqr. one of our Justices of our Said Court the 20th day of August in the
11th Year of our Dominion &c Anno Dom. 1761
      Att which day here Came the afd. Nicholas McCubbin by Litt: Dennis his Attorney and the

Sheriff to witt John Dennis Gent now here Returned that ^ by Virtue of the Writt afd. Made known unto
the afd. Purnall Newbold by Broughton Cullin and John Doe Good and Lawfull men of his Bailywick that
he Sould be and Appear before the Justices within Mentioned on the day and place within Contained to Shew Cause
as within to him it was Commanded                           Purnall Newbold
                                                        And the Said ^ Nicholas McCubbin altho So forewarned being
Solemnly Called to Shew Cause Came not but made default and upon this the Said Nicholas McCubbin
Prays Execution Against the Said Purnall Newbold for the Damages afd. According to the form and
Effect of the Recovery afd.    Therefore it is Considered that the afd. Nicholas McCubbin have
Execution Against the afd. Purnall Newbold for the Damages afd. in the Scire facias afd. Mentioned
According to the force form and Effect of the Recovery afd.    Also it is Considered that the afd. Nicholas

for his Costs and Charges Sustained by Means of the delay of the Execution of the Judgment afd. and that

?4..10..0    October the 16th. 1761 Came Levin Ballard before me




   the Subscriber one of his Lordships Justices of Somerset
County and Made Oath on the Holy Evangeles of the Almighty God that Such Articles as they Stand Charged in the
Above Account and Marked thus L:B were Sold by him and that he never Received Any part or parcell of the
within Account by himself or Any other person for his use directly or Indirectly or Security or Satisfaction for
the Same more than Crd. is Given for to the Best of his knowledge         Sworn before    Thos. Jones
   Somerset to wit    Whereas it is this day made Appear to my Satisfaction that Henry Caukwell is Justly Indebted
to Levin Ballard the Sum of three pounds Nine Shillings and that the Said Henry Caukwell is fled from
Justice in Order to defraud his Creditors    These are therefore in his Lordships Name to Charge you in behalf
of the Said Levin Ballard to Issue Attachment Against the Goods and Chattles Rights and Credits of the Said
Henry Caukwell for the afd. Sum of three pounds Nine Shillings and also the Incident Costs thereon herein
fail not Given under my hand and Seal the 16th day of October 1761                             Thos. Jones {Seal}
