Oath to the Same &c

                                                             and Absolom Outen
                     Ordered that Samuel Horsey ^ Recover Against Smith Horsey Twenty four pounds of Tobacco Each
                                                                       Each
being due unto them for their Attendance One day ^ as an Evidences on behalf of the Said Smith Horsey Against
Benjamin Coulbourn they haveing Made Oath to the Same &c

Ordered that William Wheatly and Bell Maddox Recover Against Sampson Wheatly Ninety Six pounds of
                                                                                             Each
Tobacco Each being due unto them for their Attendance four days ^ as an Evidences on behalf of the Said Sampson
Wheatly Against Stephen Cottingham they haveing Made Oath to the Same &c

Ordered that George Wilson and Jacob Mathews Recover Against Stephen Cottingham forty Eight pounds
                                                                                                                              the Said Sampson Wheatly
of Tobacco Each being due unto them for their Attendance Two days Each as Evidences on behalf of ^ his Lordship
Against Stephen Cottingham he haveing Made Oath to the Same &c

Ordered that John Wilson Recover Against Stephen Cottingham One hundred and Twenty Pounds of
Tobacco being due unto him for his Attendance five days as an Evidence on behalf of the Said Stephen
Cottingham he haveing Made Oath to the Same &c.

@    Command was Given to the Sheriff of Somerset County that he Should take William
WH    Wm. Baly    Baly Late of Somerset County Planter if he Should be found in his Bailywick and him Should Safe
keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes
Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Mathew
Cannon of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Mathew here &c
           Att which day here Came the afd. Mathew Cannon by Josiah Polk his Attorney and the Sheriff
to witt John Dennnis Gent now here Returned that he had taken the afd. Wm. Baly whose body here at this ay
he had Ready to Answer the afd. Mathew Cannon of the afd. plea
           Whereupon the Said William Baly at the prayer of the afd. Mathew Cannon is Adjudged to
Give Special Bail to the Action afd. Thereupon a Certain Perkins Venables of Somerset County planter his
Present here in Court in his Proper Person undertook for the Said Wm. Baly that if it Should happen that
Judgment in the plea afd. Should be Rendred for the Said Mathew Cannon Against the afd. Wm. Baly or
that he the Said Wm. Baly Should be therein Convict that then he theSaid Wm. Baly Should pay and
Satisfie unto the afd. Mathew Cannon the Judgment of the Court thereupon or Render his body in Execution
of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said
Perkins Venables will do the Same for him &c
           Whereupon the Said Wm. Baly puts in his Place William Hayward Gent Attorney at
Law Against the afd. Mathew Cannon in the afd. plea
           And thereupon at the prayer of the Parties afd. day is to them now here Given untill next Court
to be held at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing
to the Parties afd. &c
                Att which day here Came the parties afd. by their Attorneys afd. And hereupon the Said
Mathew Cannon Complained Against the afd. Wm. Baly in the plea afd. in form following
Somerset fst William Baly Late of Somerset County Planter was Attached to Answer unto Mathew Cannon
of A plea of trespass upon the Case &c
      And Whereupon the Said Mathew by Josiah Polk his Attorney Complains that whereas the Said
William on the first day of January Anno Dom. one thousand Seven hundred and Sixty One at the County afd.
was Indebted unto the Said Mathew in the Sum of four Pounds Seven Shillings and Six pence Curt Money of
Maryland for the Articles in the Account hereto Annexed Mentioned And So thereof Indebted being the Said
William on Consideration thereof Afterwards to witt the day and Year afd. at the County afd. upon himself did
Assume and to the Said Mathew then and there faithfully Promise that he the Said William when he Should
be thereto afterwards Required the Sum of Money afd. unto the afd. Mathew he would faithfully pay and Content
Nevertheless the Said William his Promise and Assumption afd. in form afd. Made not Regarding the Sum of
Money afd. unto the afd. Mathew he hath not paid or him for the Same in Any Sort Contented but that to doe hath
Refused and Still doth Refuse Altho the Same to do afterwards to wit the day and Year afd. at the
