August Court 10 107 County afd. and often Since that time by the Said Mathew Required to the Damage of the Said Mathew ten pounds Curt Money of Maryland and thereof he brings Suit &c Pledges &c. J: Doe & R: Roe
the Damage of the Same Mathew by him by Occasion of the Premisses in that part Sustained the Same William Saith and Acknowledgeth that the afd. Mathew hath Sustained Damages by Occasion of the premisses beyond his Costs And Charges by him About his Suit in that part Apposed to four pounds Seven Shillings and Six pence Curt Monty and not More and because the afd. Mathew denys not this but the Same Allegation Grants to be true prays Judgment for those Damages Above Acknowledged together with his Costs and Charges afd. to him to be Adjudged Therefore by Consent of the Parties afd. it is Considered that the afd. Mathew Cannon Recover Against the afd. William Baly his Damages Six pence afd. to the afd. four pounds Seven Shillings ^ Curt Money of Maryland by the Same William in form afd. Acknowledged as also Pounds of tobacco for his Costs and Charges afd. to the Same Mathew at his 214 Request by the Court now here of the Assent of the parties afd. Adjudged which Certain Damages in the Whole Amount to four pound Seven Shillings and Six pence Curt Money and Pounds of Tobacco And the afd. William in Mercy &c
at princess Ann Town the third Tuesday of June Anno Dom. one thousand seven hundred and Sixty one to answer unto Samuel Atkinson of a plea that he render him Twenty five pounds Curt Money of Maryland which To him he owes and unjustly detains and so forth and the same Day is given to the afd. Isaac Here &c Att which day here came the afd. Isaac Atkinson by Littleton Dennis his Attorney and the sheriff to witt John Dennis Gent now here returned that he had taken the afd. John Evans whose body here at this day he had ready to answer the afd. Samuel Atkinson of the afd. Plea as to him it was commanded Whereupon the said John Evans at the prayer of the afd. Samuel Atkinson is adjudged to give special Bail to the action afd. Thereupon a certain present here in court in his proper person undertook for the said John Evans and assumed upon himself that if it should happen that Judgement in the plea afd. should be rendred for the said Samuel Atkinson against the afd. John Evans or that the afd. John should be therein convict that then he the said John should pay and satisfy unto the afd. Samuel the Judgement of the court thereupon or Render his body in Execution of such Judgement to the prison of the sheriff of somerset county in satisfaction thereof or that he the said will do the same for him &c Whereupon the said John Evans puts in his Place William Hayward Gent Attorney at Law against the afd. Samuel Atkinson of the afd. plea And thereupon at the prayer of the parties afd. Day is to them now here given untill next court to be held at princess Ann Town the third tuesday of August then next following in the state that now saveing to the parties afd. Att which day here came the parties afd. by their Attorneys afd. and hereupon the said Samuel Atkinson complain ed against the afd. John Evans in the plea afd. in form following Somerset fst John Evans Late of somerset county planter Otherwise called I John Evans Carpender of Somerset County was Summoned to answer unto Samuel atkinson of a plea that he render him twenty five pounds current Money of Maryland which to him he owes and unjustly detains And Whereupon the said Samuel by Littn Dennis his Atty says that whereas the said John the xxviii Day of February Anno Dom. MDCCLX at the county afd. by his certain writing obligatory which the said Samuel Sealed with the seal of the said John here in Court shews whose date is the day and year afd. did acknowledge himself to be held and firmly Bound unto the said Samuel in the said sum of twenty five pounds current Money to be paid unto the said Samuel when he the said John should be thereto afterwards Required Nevertheless the said John altho often required the afd. sum of Money unto the said Samuel he hath not rendered but the same to him to Render hath denyed & still doth deny and unjustly detain to the Damage of the said Samuel thirty pounds Current money & thereof he brings Suit &c J Doe pledges of prosg R. Roe And the afd. John Evans by his Attorney afd. comes and Defends the force and injury when &c and saith that he cannot deny the action afd. of the afd. Samu- el Atkinson nor but that the writing Obligatory afd. is the Deed of him the said John Evans nor but that he owes the afd. Samuel Atkinson the afd. twenty five pounds in manner and form as the afd. Samuel Atkinson above against him hath declared Therefore it is considered that the afd. Samuel Atkinson Recover against the afd. John Evans his Debt afd. and his Damages by occasion of the [illegible] 1/2 detention of that same Debt to Pounds of Tobacco to the same Samuel of his assent by the court here adjudged & the afd. John in Mercy &c |
