August Court 1761 105 Shillings and Two pence Curt Money of Maryland which to him he Owes and unjustly Detains and So forth And Whereupon the Said John by William Allen his Attorney Says that Whereas the Said Isaac the fourteenth day of febry Anno Dom. MDCCLX at Somerset County afd. by his Certain Writing Obligatory which the Said John with the Seal of the Said Isaac Sealed here to the Court Shews whose date is the Same day and Year afd. Acknowledged himself to be held & firmly bound unto the Said John in the Sum of Forty Pound Sixteen Shillings and Two pence Curt Money of Maryland to be paid to the Said John when he the Said Isaac Should be thereto Afterwards Required Nevertheless the Said Isaac tho often thereto Required the Sum of Money afd. unto the Said John hath not paid but the Same to him to pay hitherto Altogether hath Refused and Still doth Refuse and Unjustly deny Whereupon the Said John Says he is Worse And hath Damage to the Value of forty Pound Sixteen Shillings and Two pence Curt Money of Maryland and thereof he brings Suit and So forth Pledges &c. J. Doe & R. Roe And the afd. Isaac Dashiell in his Proper Person Comes and Defends the force and Injury when &c And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is Given to the afd. John here also &c Att which day here Came as well the afd. John White by his Attorney afd. as the afd. Isaac Dashiell in his Proper Person and the said Isaac as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. John White nor but that the Writing Obligatory afd. is the deed of him the Isaac nor but that he Oweth the Same John the afd. forty Pound Sixteen Shillings and Two pence Curt Money in Manner and form as the afd. John above Against him hath Therefore it is Considered that the afd. John White Recover Against the afd. Isaac Dashiell his Debt afd. and his Damages by Occasion of the detention of that Same debt to 274 Pounds of Tobacco to the Same John of his Assent by the Court here Adjudged and the afd. Isaac in Mercy &c. with Stay of Exn untill the first day of next June &c
a Certain tract of Land Called Morrises Hope or the Bounds of Any other Lands on which the Bounds of the afd. Land depends We therefore Require you or Any three or two of You at Some and Place as to You or Any three or two of you Shall Seem Convenient You meet on the afd. Land Called Morrises Hope or Any other Land on which the bounds of the afd. Land depend You first haveing taken Your Oaths on the holy Evangels of Almighty God According to Act of Assembly in Such Case Provided and there Cause to Come before you or Any three or two of you all Such Evidences as Shall be to you or Any three or two of you Nominated by the Said Complainant or Deft and that you or Any three or two of you Examine them upon their Corporall Oaths to be by you or Any three or two of you Administred on the holy Evangels of Almighty God in the Presence of the Complainant or Deft. if Any Touching the truth or Remembrance of their knowledge or Any thing that may Relate to the Cause afd. and that Reduceing the Severall Depositions into Writing You Send the Same with this our Commission under your hand or Any three or two of Your hands and Seals to us to our County Court of Somerset with all Convenient Speed Witness Isaac Handy Esqr one of our Justices of our Said Court the 21st day of March Anno Dom. 1761 And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of August being the Eighteenth day of the Same Month Anno Dom. one thousand Seven hundred and Sixty One before the Justices thereof Came the within Commission and Returned the Same Endorsed in Manner following with the Severall depositions thereto Annexed April 6th. 1761 Then Personally Came before me the Subscriber One of his Lordships Justices of the Peace in and for the County of Somerset the within Named John Broughton and was duely Quallified According to An Act of Assembly in Such Case Lately made and Provided and So forth Sworn before Samuell Addams Aprill ye. 8th. day 1761 Then Personally Came Edward Waters before me the Subscriber One of his Lordships Justices of |
