August Court 1761 104 John and James have besought us to Grant them their Proper Remedy in this behalf and being Willing that is Just in this behalf Should be done Command You that by Good and Lawfull men of Your Bailywick you Give Notice to the Said Signey Brown that he be and Appear before our Justices of our County Court of Somerset to be held at Princes Ann Town the third Tuesday of March next to Shew Cause if he hath or Can Say any thing for himself why the Said John and James Ought not to have Execution for the Sum of Money and Tobacco afd. Against him the afd. Signey According to the force form and Effect of the Recovery afd. if he Shall think fit and further to do and Receive what our Same Court Shall then and there Consider of Concerning him in this behalf and have you then and there the Names of those by whom to him you Shall Give Notice and this Writt Witness Isaac Handy Esqr One of our Justices of our Said Court the 22d day of November Anno Dom. 1760 Att which day here Came the afd. John & James by Wm. Hayward their Attorney and the Sheriff to wit John Dennis Gent now here Returned that he had by Virtue of the Writt afd. Made known unto the afd. Signey Brown by John Graham and Hugh Porter Good and Lawfull men of his Bailywick that he be and Appear before the Justices within mentioned on the day and place within mentioned to Shew Cause as within to him it was Commanded And the afd. Signey Brown by George Hayward his Attorney Comes and prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of June then next following and he hath it and the Same day is Given to the afd. John & James here also &c Att which day here Came as well the afd. John Weatherly & James Trahern as the afd. Signey Brown by their Attorneys afd. And hereupon the Said Signey prays further Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is given to the afd. John & James here also &c Att which day here Came as well the afd. John and James as the afd. Signey by their Attorneys afd. And hereupon the Said Signey Saith that he Cannot deny but that the afd. John Weatherly and James Trahern Ought to have Execution Against him the Said Signey According to the tenor of the Scire facias afd. Therefore it is Considered that the afd. John Weatherly and James Trahern have Execution Against the afd. Signey Brown for the Damages afd. in the Scire facias afd. Mentioned &c. And also it is Considered that the afd. John and James Recover Against the afd. Signey 195 Pounds of Tobacco for his Costs and Charges Sustained by means of the delay of Execution of the Judgment afd. and that the afd. John and James have thereof Execution &c
of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One to Answer unto John White of A plea that he Render him the Sum of forty Pound Sixteen Shillings and two pence Curt Money of Maryland which to him he Owes and unjustly detains and So forth And the Same day is Given to the afd. John here &c Att which day here Came the afd. John White by William Allen his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Isaac Dashiell whose body here at this day he had Ready to Answer the afd. John White of the afd. plea as to him it was Commanded Whereupon the Said Isaac Dashiell at the Prayer of the afd. John White is Adjudged to Give Special Bail to the Action afd. Thereupon a Certain Joseph Allen of Somerset County planter present here in Court in his Proper Person undertook for the Said Isaac Dashiell And Assumed upon himself that if it Should happen that Judgment in the plea afd. Should be Rendred for the Said John White Against the afd. Isaac Dashiell or that he the Said Isaac Should be therein Convict that then he the Said Isaac Should pay and Satisfie unto the afd. John White to the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Joseph Allen will do the Same for him &c. And thereupon at the Prayer of the Parties afd. day is to them now here Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the parties afd. &c Att which day here Came As well the afd. John White by his Attorney afd. as the afd. Isaac Dashiell in his Proper Person and hereupon the Said John declared Against the afd. Isaac in the plea afd. in form following Somerset fst Isaac Dashiell Late of Somerset County Planter Otherwise Called I Isaac Dashiell of Somerset County Planter was Summoned to Answer unto John White of A plea that he Render him the Sum of forty Pound Sixteen Shillings |
