Somerset County Judicial Records, 1760-1763

Whereupon the Said Daniel Henderson at the prayer of the af^d. Alexander Stuart is Adjudged to give Special Bail to
the Action af^d.    Thereupon a Certain Joseph Venables of Somerset County Planter Present here in Court in his Proper
Person undertook for the Said Daniel Henderson and Assumed upon himself that if it Should happen that Judgment
in the Plea af^d. Should be Rendred for the Said Alex^r. Stuart Against the af^d. Daniel Henderson or that he the Said
Daniel Should be therein Convict that then he the Said Daniel Should pay and Satisfie unto the af^d. Alexander
the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the Prison of the Sheriff of
the County af^d. in Satisfaction thereof or that he the Said Joseph Venables will do the Same for him &^c
        And the af^d. Daniel Henderson In his Proper Person Cometh and defendeth the force and Injury when &^c. And
Saith that he Cannot deny the Action af^d. of the af^d. Alex^r. Stuart nor but that he did Assume upon himself in Manner and
form as the af^d. Alex^r. Above Against him hath Complained and as to the Damage of the Said Alex^r. by him by Occasion of
the Premisses in that Part Sustained the Same Daniel Saith and Acknowledgeth that the af^d. Alex^r. hath Sustained
Damages by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to five
pound One Shilling and Eleven pence Cur^t Money and not More and because the af^d. Alex^r. Denys not this but the
Same Allegation Grants to be true prays Judgment for those Damages above Acknowledged together with his Costs and
Charges af^d. to him to be Adjudged &^c         Therefore by Consent of the parties af^d. it is Considered that the af^d.
Alex^r. Stuart Recover Against the af^d. Daniel Henderson his Damages af^d. to the af^d. five pound One Shilling and
190 3/4    Eleven pence Cur^t Money by the Same Daniel in form af^d. Acknowledged as also
Pounds of Tobacco for his Costs and Charges af^d. to the Same Alex^r. at his Request by the Court now here of the Assent of
the Parties af^d. Adjudged which Certain Damages in the Whole Amount to five pound One Shilling and Eleven pence
Cur^t Money and                                                         Pounds of Tobacco and the af^d. Daniel in Mercy &^c

@    Command was Given to the Sheriff of Somerset County that he Should Take William

LD    W^m. Hath    Hoath Late of Somerset County Planter if he Should be found in his Bailywick and him Should Safe keep

So that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann
Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty to Answer unto William Pollit
of A plea wherefore with force and Arms he the Said William Hath in and upon the af^d. William Pollit at Somerset
County af^d. an Assault did Make and him the Said William Pollit then and there did Beat Wound and Evilly treat so
that of his Life it was Much dispaired and Other harms to the Said William Pollit then and there did to the Great
Damage of the Said William Pollit And Against Our peace that now is and So forth    And the Same day is Given to the af^d.
W^m. Pollitt here &^c.
             Att which day here Came the af^d. W^m. Pollit by W^m. Hayward his Attorney and the Sheriff to witt John
Dennis Gen^t now here Returned that he had taken the af^d. W^m. Hath whose body here at this day he had Ready to Answer
the af^d. W^m. Pollit of the af^d. Plea as to him it was Commanded
           Whereupon the Said W^m. Hath Put in his place Litt. Dennis Gen^t Attorney at Law Against the
af^d. W^m. Pollit of the af^d. Plea
      And thereupon at the Prayer of the Parties af^d. day is to them now here Given untill next Court to be held
at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to the Parties af^d.
      Att which day here Came the Parties af^d. by their Attorneys af^d. And hereupon the Said W^m. Pollit Complains
Against the af^d. W^m. Hath in the plea af^d. in form following       Somerset fs^t William Hoath Late of Somerset

on the         day of         Anno Dom. MDCCL      at Somerset County af^d. With force and Arms in and upon him
