August Court 1761 103 Judgment to the Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said James Finch will do the Same for him &c And the afd. Samuel Callaway in his Proper Person Comes and defends the force and Injury when &c And Saith that he Cannot deny the Action afd. of the afd. Alexander Stuart nor but that he did Assume upon himself in Manner and form as the afd. Alexander Above Against him hath Complained and as to the Damage of the Same Samuel Alexander by him by Occasion of the Premisses in that part Sustained the Same ^ that the afd. Alexander hath Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him About his Suit in that part Apposed to five Pound Seven Shillings and Two pence Curt Money of Maryland & not More and because the afd. Alexr. denys not this but the Same Allegation Grants to be true prays Judgment for those damages Above Acknowledged together with his Costs and Charges afd. to him to be Adjudged &c Therefore by Consent of the Parties afd. it is Considered that the afd. Alexander Stuart Recover Against the afd. Samuel Callaway his Damages afd. to the afd. five pound Seven Shillings and Two pence 1712 Curt Money by the Same Samuel in form afd. Acknowledged as also Pounds of Tobacco for his Costs and Charges afd. to the Same Alexr. at his Request by the Court now here of the Assent of the Parties afd. Adjudged which Certain Damages in the Whole Amount to five pound Seven Shillings And Two pence Curt Money and Pounds of Tobacco and the afd. Samuel in Mercy &c
Princes Ann Town the third Tuesday of August Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Alexander Stuart of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Alexander here &c. Att which day here Came the afd. Alexander Stuart by Josiah Polk his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Daniel Henderson whose body here at this day he had Ready to Answer the afd. Alexander Stuart of the afd. plea as to him it was Commanded And hereupon the Said Alexander Stuart Complained of the afd. Daniel Henderson in the plea afd. in form following Somerset to wit Daniel Henderson Late of Somerset County Planter was Attached to Answer unto Alexander Stuart of a plea of trespass upon the Case and So forth And Whereupon the Said Alexander by Josiah Polk his Attorney Complains that the Said Daniel on the Second day of May Anno Dom. one thousand Seven hundred and Sixty One at the County afd. was Indebted unto the Said Alexander in the Sum of five pounds One Shilling and Eleven pence Curt Money of Maryland for the Articles in the Account hereto Annexed mentioned and So thereof Indebted being the Said Daniel on Consideration thereof Afterwards to wit the day and Year afd. at the County afd. upon himself did Assume And to the Said Alexander then and there faithfully Promised that he the Said Daniel when he Should be thereto Afterwards Required unto the Said Alexander the Sum of Money afd. he Would faithfully pay and Content Nevertheless the Said Daniel his Promise and Assumption afd. in form afd. made not Regarding the Sum of Money afd. to the afd. Alexander he hath not paid nor him for the Same in Any Sort Contented but that to doe hitherto hath Refused and Still doth Refuse Altho the Same to do afterwards to wit the day and Year afd. at the County afd. and often Since that time by the Said Alexander Required to the damage of the Said Alexander ten pound Curt Money of Maryland and thereof he brings Suit and So forth Pledges &c. J. Doe & R. Roe
