        August Court              1761                   104
the Said William Pollit an Assault did Make and him the Said William Pollit then and there did beat
Wound and Evilly treat so that of his Life it was Much dispaired and Other harms to him the Said William
Pollit then and there did to the Great Damage of the Said William Pollit and Against the Peace of the
Right Honrble the Lord Propry that now is his Good Rule and Government and So forth and to the Damage of
the Said William Pollit Twenty Pounds Curt Money of Maryland and thereof he brings Suit and So forth
                                                                                 Pledges &c. J: Doe & R: Roe
And the afd. Wm. Hath by Litt. Dennis his Attorney Comes and defends the force and Injury when &c. And prays
Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of November
then next following and he hath it and the Same day is Given to the afd. Pollit here also &c
           Att which day here Came as well the afd. Wm. Pollit as the afd. Wm. Hath by their Attorneys afd. and
there upon the Said Wm. Hath prays further Leave thereof to Imparle here untill next Court to be held at
Princes Ann Town the third Tuesday of March then next following and he hath it and the Same day is Given
to the afd. Wm. Pollit here also &c
           Att which day here Came as well the afd. William Pollit as the afd. Wm. Hath by their Attorneys
afd. And hereupon the Said Hath prays further Leave thereof to Imparle here untill next Court to be held at
Princes Ann Town the third Tuesday of June then next following and he hath it and the Same day is Given
to the afd. Pollit here also &c
           Att which day here Came as well the afd. Wm. Pollit as the afd. Wm. Hath by their Attorney
afd. And hereupon the Said Hath Prays further Leave thereof to Imparle here untill next Court to be held at Princes
Ann Town the third Tuesday of August then next following and he hath it and the Same day is Given to the afd.
Pollit here also &c       Att which day here Came as well the afd. Wm. Pollit as the afd. Wm. Hath by their
Attorneys afd. and hereupon the Said Hath as before defends the force and Injury when &c And Saith that he Cannot
deny the Action afd. of the afd. Pollit nor but that he is Guilty of the Premisses in the declaration mentioned in Manner
and form as the afd. Pollit Above Against him hath Complained and as to the Damage of the Same Pollit by him by
Occasion of the Premisses in that Part Sustained the Same Hath Saith and Acknowledgeth that the afd. Pollit
hath Sustained Damages by Occasion of the Premisses beyond his Costs and Charges by him About his Suit in that
Apposed to Seventeen Shillings Curt Money and not More and because the afd. Pollit denys not this but the Same
Allegation Grants to be true prays Judgment for those Damages above Acknowledged together with his Costs and
Charges afd. to him to be Adjudged &c.    Therefore by Consent of the Parties afd. it is Considered that the afd. Pollit
Recover Against the afd. Hath his Damages afd. to the afd. Seventeen Shillings Curt Money by the Same Hath in
259    form afd. Acknowledged as also                                               Pounds of Tobacco for his Costs and Charges
afd. to the Same Pollit at his Request by the Court now here of the Assent of the Parties afd. Adjudged which
Certain Damages in the Whole Amount to Seventeen Shillings Curt Money &
Pounds of Tobacco and the afd. Hath in Mercy &c

@    Command was given to the Sheriff of Somerset County that he Should Take Stephen Cottingham
WH    Stephen Cottingham    Late of Somerset County Planter if he Should be found in his Bailywick and him Should Safe keep so
that he might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town
the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Sampson Wheatly
of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Sampson Wheatly here &c
        And hereupon the Said Sampson Wheatly Complained of the afd. Stephen Cottingham in the plea
afd. in form following    Somerset fst Stephen Cottingham Late of Somerset County Planter was Attached to
Answer unto Sampson Wheatly of A plea of trespass upon the Case &c
      And Whereupon the Said Sampson by Littleton Dennis his Attry Complains that Whereas the Said Stephen
on the first day of December Anno Dom. MDCCLIX at the County afd. was Indebted unto the Said Sampson
in the Sum of four pound Two Shillings and one half penny Curt Money for the Sundry Matters and things in the
