August Court 1761 102 the Premisses in the Information afd. Above Against him Supposed in manner and form as by the Information afd. Above upon him Imposed and is Willing to pay his fine for the Same &c Whereupon all and Singular the Premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. James Dashiell for the Premisses and Offence afd. be taken &c. Which Said James Dashiell present here in Court in his Proper Person as afd. is fined the Sum of thirty Shillings Curt Money which he paid here in Court to the Sheriff for the use of the County &c Whereupon the Said James Dashiell is Ordered by the Court to Give Sery to Save and keep Indemnified the Justices of Somerset County from all Costs Charges & troubles that may Accrew by means of the birth of a Bastard Child Lately Born of the Body of Elizth. Simpson Thereupon a Certain Thomas Dashiell of Somerset County present here in Court in his Proper Person undertook for the Said James Dashiell & Acknowledged himself to be held and firmly bound unto Goods and Chattles Lands and tenements to be made and Levied if it happen that the Said James Dashiell do not Save and keep Indemnified the Justices of Somerset County Court from all Costs Charges and troubles that may Accrew by means of the Birth of a Bastard Child Lately Born of the Body of the afd. Elizth. Simpson &c.
of August Anno Dom. One thousand Seven hundred and Sixty One to Answer unto Alexr. Stuart of A plea of trespass upon the Case &c. And the Same day is Given to the afd. Alexr. here &c Att which day here Came the afd. Alexr. Stuart by Josiah Polk his Attorney and the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Samuel Callaway whose body here at this day he had Ready to Answer the afd. Alexr. Stuart of the afd. plea as to him it was Commanded And hereupon the Said Alexr. Stuart Complained of the afd. Samuel Callaway in the plea afd. in form following Somerset to wit Samuel Callaway Late of Somerset County Planter was Attached to Answer unto Alexander Stuart of a plea of trespass upon the Case and So forth And Whereupon the Said Alexander by Josiah Polk his Attorney Complains that Whereas the Said Samuel on the Second day of March Anno Dom. One thousand Seven hundred and Sixty at the County afd. was Indebted unto the Said Alexander in the Sum of five pound Seven Shillings and two pence Curt Money of Maryland for the Articles in the Accounty hereto Annexed mentioned and So thereof Indebted being the Said Samuel on Consideration thereof Afterwards to wit the day and Year afd. at the County afd. upon himself did Assume And to the Said Alexander then and there faithfully Promise that he the Said Samuel the Sum of Money afd. to the afd. Alexander when he the Said Samuel Should be thereto Afterwards Required unto the Said Alexander he would well and faithfully pay and Content Nevertheless the Said Samuel his Promise and Assumption afd. in form afd. made not Regarding the Sum of Money afd. to the Said Alexander he hath not paid nor him for the Same in Any Sort Contented but that to do hath Refused and Still doth Refuse altho the Same to do afterwards to wit the day and Year afd. at the County afd. And often Since that time by the Said Alexander Required to the Damage of the Said Alexander ten pound Curt Money of Maryland and thereof he brings Suit and So forth Pledges &c. J. Doe & R. Roe
