August Court 1761 100 Vestry and Church Wardens did Appear and the afd. Attorney of the Said Lord Propry doth Give the Said Justices here further to understand and be Informed that the afd. Mary Quinton of the Parish afd. in the County afd. did afterwards to wit the day of in the Year of our Lord One thousand Seven hundred and and Divers Other times as well before as Since at the Parish afd. in the County afd. within the Jurisdiction afd. Contrary to and after the Admonition afd. Cohabit with and frequent the Company of the Said David Contrary to the Act of Assembly in Such Case made and Provided and Against the peace of the Said Lord Propry that now is his Good Rule and Government and So forth Whereupon the Same Attorney of the Same Lord Propry Prays Advice of the Court here in the Premisses and that due Process of Law may in this Part be made Against the Said Thomas to Answer of and upon the Premisses and So forth Pledges &c. J: Doe & R: Roe Thereupon it is Commanded the Sheriff of Somerset County that he Should take the Said Mary Quinton if &c to Answer &c. And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of August being the Eighteenth day of the Same Month Anno Dom. one thousand Seven hundred and Sixty One before the Justices thereof Came the afd. Mary Quinton by Samuel Wilson her Attorney and had a hearing of the Information afd. Saith that she Cannot deny but that She is Guilty of the Premisses in the Information afd. Above upon her Imposed in Manner and form as by the Information afd. Above Against her Supposed and is Willing to Pay her fine for the Same &c. Whereupon all and Singular the Premisses being Seen and by the Court fully understood it is Considered by the Court here that the afd. Mary Quinton for the Premisses and Offence afd. in the Information afd. Above Specified be taken which Said Mary Quinton Present here in Court in his Proper Person as afd. is fined for the Premisses and Offence afd. the Sum of thirty Shillings Curt Money of Maryland which She paid here in Court to the Sheriff for the use of the County &c
in the County afd. did Commit Fornication with a Certain Negro Slave to the Jurors unknown and did permit the Same unknown Negro Slave then and there to have Carnal knowledge of her body and a Bastard Child on the Body of her the Said Sue then & there to beget to the high displeasure of Almighty God to the Evil Example of all Others in Such Case Offending Contrary to the peace of the Said Lord Propry that now is his good Rule and Government And Against the form of the Act of Assembly in Such Case made and Provided and So forth Thereupon it is Commanded the Sheriff of Somerset County that he Should take the Said Molatto Sue if &c to Answer &c And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of August being the Eighteenth day of the Same Month Anno Dom. one thousand Seven hundred and Sixty One before the Justices thereof Came the afd. Molatto Sue in her Proper Person and had a hearing of the Indictment afd. Saith that She Cannot deny but that She is Guilty of the Premisses in the Indictment afd. Mentioned above upon her Imposed in Manner and form as by the Indictment afd. Above Against her Supposed Whereupon all and Singular the Premisses being Seen and by the Court fully understood it is Considered by the Court here that for as Much as there is due to the County of Somerset Seven Years Service from Such Persons as are Guilty of Inordinate Copulation afd. And Likewise that Such Issue begot by Such Copulation become a Servant untill it Arrive at the Age of thirty One Years According to Act of Assembly in Such Case Provided &c. that the afd. Molatto Sue become a Servant for Seven Years for Such Copulation afd. and that Nelly the Issue of the afd. Sue and begot by the Copulation afd. become a Servant untill She Arrive at the Age of thirty One Years Whereupon it is Ordered by the Court her that the afd. Sue Return to her Masters Service to witt Thos. Collins and that the Said Thomas Collins Return the Said Sue to the next County Court to be held at Princes Ann Town in the Coty. of Somerset after her now Servitude Expire in order to be Sold for the Inordinate Copulation afd. and Likewise it is Ordered that John Dennis high Sheriff of Somerset County Immediately Sell Nelly the Issue of the afd. Sue and begot by the Copulation afd. to the highest Bidder for the term of thirty One Years to Commence from the time of her Birth She being now Seven Years of Age &c. And afterwards in the Same Court Came the afd. Sheriff & Returned that he by Virtue of the order afd. had Sold the afd. Nelly the Issue of the afd. Sue and begot by the Copulation for the term of thirty One Years to Commence from the time of her Birth (being now Seven Years old) to Thomas Dashiell for the Quantity of three thousand One hundred pounds of Tobacco he being the highest bidder &c |
