LAWS OF MARYLAND.

CHAP 301 .

derick, be, and they are hereby authorised to enact and pass
an ordinance or ordinances to close and shut up that part of
Middle Alley, in Frederick town, south of Carroll's Creek,
so far as the same binds and runs with the grave yard be-
longing to the Vestry of All Saints Parish, in Frederick,
and to allow the said part of said alley to be added to and
enclosed with the said grave yard, as in their discretion

May extend, &c.

Sec 2 And be it enacted, That the said aldermen and
common council may provide for the extension and connec-
tion of said Middle Alley from the southern side of Car-
roll's Creek, with All Saint's street, by some other and more
practicable way, Provided, they do not interfere with pri-
vate right, without the consent of the owners thereof

CHAPTER 301

An act defining the powers of the Moderator and Commis-
sioners, of Hagerstown

Assessment assumed

Section 1 Be it enacted by the General Assembly of Ma-
ryland, That the assessment made by order of ihe commrs
sroners of Washington county, in pursuance of an act of As-
sembly, passed at December session, eighteen hundred and
thirty four, chapter one hundred and forty four, be taken as
the basis of all taxes hereafter, to be levied by the said
moderator and commissioners; and that the said moderator

and commissioners shall have power to levy for street, I
engine, and other purposes, a tax not exceeding twelve and
a half cents on every hundred dollars north of property so
assessed.

Relating to the

plat of the town

Sec 2. And be it enacted, That in lieu of the plat autho-
rised to be made of the said town and its additions by ah act
passed at December session, eighteen hundred and twenty
one, chapter ten section three being kept as other records
of the moderator and commissioners of said town are kept,
that the said plat when made according to the directions of
said act, be entered on the land records of Washington
county, and that a certified copy thereof, be evidence in all
suits or actions in whrch the limits of said town and its ad-
ditions may be involved.
