CHAP 261

mery county, to the line of the District of Columbia, in
direct communication with the city of Washington, and to
close the old county road wherever said turnpike road
should depart from its bed and whereas, the said company,
by virtue of the powers given them by the said act, proceed-
ed to lay out and open a road in the direction aforesard,
without completing it (nearly parallel with the old county
road) and have long since abandoned it, whereby it has be
come impassable in many places for wagons or carnages of
any description, Therefore

Levy court authori-

sed

Be it enacted by the General Assembly of Maryland, 1 hat
henceforth the levy court of Montgomery county, be, and
they are hereby empowered and directed to keep in repair
the said Rockville and Washington turnpike road, and the
bridges thereon, or such part thereof as may be agreed upon
between said company and the lew court aforesaid, if said
company shall not be willing to have the whole road repair-
ed by said levy court, as other public roads are kept in said

Proviso

county Provided, the said company signify their assent in
writing, signed and legally sealed by their proper officer,
to he filed with the clerk of Montgomery County Court, and
to be recorded by him amongst the records of said county,
before the said levy court shall proceed to make any repair,
a copy of which said writing, under the seal of said county
court, shall be evidence

Sec 2 And be it enacted, That it at any time hereafter,
the said Rockville and Washington Turnpike Company
shall think fit to finish and complete said turnpike road, they
shall be at liberty to do so, provided they pay to the said
levy court for the bridges that may have been eiectcd by
said court, on said road, their value, which shall be ascer-
tained by two disinterested persons, one chosen by said com-
pany or its proper officer, and the other by the levy court of
said county and in the event of the two persons so chosen
disagreeing, they shall choose a third

Preamble

WHEREAS, it is represented to this General Assembly, by
the citizens of Queen Anne's and Caroline counties, that the
bridge over the public road at the place called the Nine
