in which a newspaper is or shall be published, of such,
times, places, and purpose, and that upon the first opening
of said books, they shall be kept open from day to day for
ten days, exclusive of Sunday, from ten o'clock A M , until
two o'clock P. M , and if at the expnation of that period,
subscriptions to the said capital stock shall not have been
obtained to the amount necessary to the incorporation of
said Bank, the said commissioners, or a majority of them,
nay cause the said books to be opened from time to time
after the expiration of said ten days, upon again giving the
notice herein before required, for the space of twelve months
thereafter, unless the said amount he sooner subscribed, and

if the subscription made necessary to the incorporation of
the said Bank shall not be obtained before expiration of
said twelve months, this act and all subscriptions under it,
shall be null and void, and if any of the said commissioners
shall die, resign, or refuse to act, the dutres devolved on
them being unfinished, another shall be appointed in his
stead by the remaining commissioners, or a majority of
them.
Sec 2 And be it enacted, That the capital stock of the
said Bank shall be two millions of dollars, in si ares of one
hundred dollars each, but may be augmented at any time
within two years atter the passage of this act, by subsccrip-
tion being made on behalf of this Slate, to an amount not
exceeding five hundred thousand dollars, or after the expi-
ration of said term, to an amount not exceeding two hun-
dred and fifty thousand dollars, aid in sums not exreed-
ing fifty thousand dollars in any year, and that as soon
as ten thousand shares of said slock shall be sub-
scribed, the proprietors of said shares, their successors and

assigns shall be, and they are hereby created, made and de-
clared to be a corporation and body politic, by the same and
style of The Merchants' Bank of Baltimore, and shall so
continue until the end of the year eighteen hundred and fifty
five, and the expiration of the first session of the General
Assembly which shall be held thereafter, and by that name
shall be ind ore hereby made able and capable in law to sue
and be sued, plead and be impleaded, answer and be an-
swered, defend and be defended, in courts of record or any

other place whatsoever, also to make, have, and use a com
mon seal, and the same to break, alter and renew at their
pleasure, and to ordain, establish and put into execution such
by laws, ordinances, and regulations, as shall seem necessa-
ry and convenient for the government of the said corpora-
tion, the same not being contrary to law or the provisions of
