CHAP 103

Report on oath

Sec 5 And be it enacted, That the said Trustee shall
make a report, on oath, and render a just and true statement
of her proceeding in the premises, to the Orphans' Court
aforesaid, and on her neglect so to do her bond as Trustee,
shall be answerable for any damage occasioned by such ne-

Compensation

gleet, and the Orphans' Court foresaid, may allow the
Trustee such compensation for her trouble as to them shall,
appear proper and reasonable, not exceeding ten per cent
on the amount of sales

Case of death of

minor

Sec 6 And be it enacted That if either or both the said
children shall die before they shall arrive at the age of
twenty one years, the proceeds of the lands shall descend
in the same manner as the land would have descended, if
the same had not been sold

Sec 7 And be if enacted, That if the Trustee herein ap-
pointed, shall die before the sale or conveyance of the land
herein authorised, to be sold and conveyed then and in that
case, the Orphans' Court of said county are hereby autho-
rised and required to appoint a Trustee to carry into effect
the several provisions of this act

All act for the better payment of the members of the Levy
Court of Frederick County

Mileage allowance

Be it enacted by the General Assembly of Maryland Hat
each and every member of the Levy Court of Frederick
county who shall reside more than five miles from the place
of holding said Court, shall, in addition to the per diem al
lowed him by law, be entitled an allowance of twelve and
a half cents for every mile exceeding the first five miles that
his place of residence shall be distant from the place of
holding the said Court, to be allowed him in going to the
said Court to be levied, collected and paid in the same
manner, and at the same time, with his or their per diem
allowance
