pany or corporation, and if no appearance be entered for
such company at the term next succeeding the issuing of
Such writ or process judgment by default shall be rendered

plaintiffs claim, to be proved to and ascertained by a jury as
aforesaid, Provided always, that before such judgment shall
be rendered, in case the authority of any agent shall be re-
voked as aforesaid, and the said writ on process, shall be
served on such agent, that evidence shall be furnished to the
court where such suit is pending, by affidavit or affirmation
of the party serving the same, made before the Mayor oi
some corporation or Judge of some court oi the United
Slates, to be attested by the seal of such corporation, or of
the court of which such person may be judge, that a copy
of such writ or process so served on such agent, has been
delivered to the President or two Directors of such compa-
ny or corporation within the state where such company or
corporation shall have been incorporated.

CHAPTER 90

An act in relation to the Clerk of the Court of Appeals for
the Western Shore of Maryland

Passed Feb 23 1835

Section 1 Be it enacted by the General Assembly of Mary-
land, That it shall and may be lawful, for the clerk of the
Court of Appeals for the Western Shore of Maryland, to
place all fees which may be due him, now, or hereafter,
from the citizens of this state, or incorporated institutions,
in the hands of the sheriffs of the several counties, for col-
lection, at any time prior to the twentieth day of March, in
each and every year, and thai the said sheriffs shall be bound
to receive the same for collection, and to account with, and
pay to the said clerk, all sums of money by them to be re-
ceived thereon, in the same manner, and at the same time,
as they are now required to do by the existing laws, any
law or usage to the contrary notwithstanding

Sec 2. And be it enacted, That the sureties of the said
sheriffs, shall be responsible for the performance of the du-
ty of their principles in this respect, to the same extent as
they are responsible for them, in relation to the fees of oth-
