CHAP. 87.

A good barrel may
be substituted for
a defective one.

Sec. 2. And be it enacted, That if any barrel shall have
been so damaged, or otherwise defective, as not to admit of
its being repaired, it shall be lawful for the owner or own-
ers, his, her or their agent, to substitute a good and sufficient
barrel, and pay for the packing of the same, or to make
such deduction from the flour as may be agreed upon be-
tween the vendor and purchaser; and the inspector inspect-
ing such damaged or defective barrel, shall, under the like
penalty as above, certify to what in his opinion, such da-
mage or defect is owing.

Sec. 3. And be it enacted, That all penalties incurred
under the provisions of this act, shall be recovered before
any justice of the peace for this state, in the same manner
as other small debts are now collected, one half thereof to
the informer, and the other half to the state.

Repeal

Sec 4 And be it enacted, That all acts or parts of acts,
inconsistent with, or repugnant to the provisions of this act,
be and the same are hereby repealed.

CHAP. LXXXVIII.

Passed Feb. 25.1829

An Act Supplementary to an act for the opening of Pratt-
Street, passed at December session eighteen hundred

Wood or lumber
not to be landed

at Pratt street
wharf

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland. That from and after the first day of April next, it
shall not be lawful for any person or persons whatsoever, to
land any wood or lumber, (staves excepted) on that part of
Pratt-street commonly called Pratt-street Wharf, which lies
between Light street and Franklin Lane.

Penalty for so do-
ing

Sec. 2. And be it enacted, That if any person or per-
sons shall violate the provisions of the first section of this
act, he, she or they, shall be subject to a fine of twenty dol-
lars for every such offence, the one half to go to the inform-
er, and the other half to the state, and that the said fine may
be sued for in the name of the state, before any justice of
the peace of the city of Baltimore, and the same proceed-
ings had thereon for the recovery, as in the case of suits for
the recovery of small debts out of court before justices of
the peace.

Return of fines
to be made to the

treasurer

Sec. 3. And be it enacted, That it shall be the duty of
every justice of the peace in the said city to make an an-
nual return to the treasurer of the western shore of all fines
imposed by him under this act, and to recover and receive,
for the use of the state, the proportion of said fines due to
the state, and to account for and pay over the same to the
said treasurer at the time of making his said annual return.

Sec. 4. And be it enacted, That it shall be the duty of
the mayor of the city of Baltimore to enforce the provisi-
ons of this act in its first section.
