Where the state is plaintiff, and a
sheriff returns property as taken in execution
and remaining in his possession
unsold for the want of buyers, and said
sheriff becomes afterwards insolvent or
willingly neglects to make sale &c the
attorney prosecuting for the state in
that behalf, may &c. issue a new execution
directed to the sheriff &c. for the
time being, by virtue of, which said officer
shall proceed to seize and sell the
said goods, taken by the insolvent or
neglecting sheriff &c.
Requiring, to receive and collect such
fees &c. as shall be placed in their hands
by the legal representatives of the late
Clerk of Calvert county court, by the
12th May &c. their bonds responsible,
Entitled to $1 for serving subpœna
on party implicated in a petition for divorce,
and 50 cents on each subpœna
served by him on witnesses to attend
such cases,
