CHAP. 97.

and they are hereby fully authorised and empowered
to lay
out, open and make good, a road from the new bridge across
the Boomery Branch, near Turner's Mill, to intersect the
state line at or near Bethel Meeting House, in the state of
Delaware, and a new county road leading from the village of
Federalsburgh, in said county, to intersect the main road
leading to the village of Denton, at or near Manship's Old
Field.

Damages, how ascertained.
Appeal provided.

Sec. 2. And be it enacted,
That if the commissioners, and
the person or persons through whose lands and premises the
said road or roads may go, cannot agree as to the damages
which such owner or owners may sustain in consequence of
the opening and making the said roads, then it should be lawful
for the commissioners, or a majority of them, to choose one
good and lawful freeholder, and the party complaining, to
choose one other person of like qualifications, who shall appoint
some certain day, and who shall give not less than ten
days notice to the parties concerned, to meet, view and assess
the damages so occasioned, or if they disagree in their opinions,
then the two appraisers appointed as aforesaid, shall
choose one other good and lawful freeholder to act with them,
whose valuation shall be final and conclusive; Provided always
and it is hereby enacted, That it shall be lawful for any person
aggrieved by the decision of the freeholders aforesaid, or his
or her guardian, to appeal to the county court of Caroline
county at the term next ensuing the final decision of said freeholders,
whereupon such person shall be entitled to a trial by
jury in said court, to ascertain the damages sustained by the
condemnation of land for the road or roads aforesaid.

Sec. 3. And be it enacted,
That the said commissioners, or
those who may be appointed to value and determine said damages,
so as aforesaid, shall make out in writing the amount of
the damages, to whom the same is due, and the sum due to
each one concerned, and return the same to the Levy Court
of Caroline county, and the said court shall levy the amount
for the use of the persons to whom the same shall appear to
be due, in the same manner as other county charges are now
levied; and that the said appraisers shall be entitled to the
sum of one dollar and fifty cents for every day they shall act
or attend as such, to be levied as aforesaid.
