CHAP. 73.
|
Sec. 5. And be it enacted,
That if any person or persons,
through whose land the road to be laid out by virtue of this
act shall pass, believe that the amount paid him, her, or them,
is not a fair and full equivalent for the land, he, she, or they,
shall be at liberty to appeal by petition to the next county
court, before the judges thereof, who are hereby empowered
and directed to hear the allegations and proofs of both parties,
(the Levy Court of Prince George's county to be made defendant
in such appeal) and determine the same according to the
law of the land, and the equity and right of the matter, at the
same term of said court to which the appeal shall be made,
without any further continuance or delay, unless it should appear
to the satisfaction of said court, that further time ought to
be given to the party applying for the same, to enable the said
court to determine said appeal according to the law of the
land, and the right and equity of the matter, either of the said
parties may demand a trial by jury, or leave the cause to be
determined by the court; and if any sum shall be adjudged
by the said court to the party appealing on the trial and final
determination of said cause, the same, with such costs as may
be adjudged by said court, shall be levied for the use of the
party so recovering and collected and paid in the same manner
as other county charges are: Provided always, that if the
said county court should confirm the decision of the commissioners,
the party appealing shall pay all costs of said appeal.

Sec. 6. And be it enacted,
That each commissioner appointed
by this act shall be entitled to one dollar and twenty five
cents, for each and every day he may be actually and necessarily
engaged in the discharge of his duty; and before the said
commissioners shall act as such, they shall take an oath or
affirmation, for the due execution of the trusts reposed in them
by this act; and in case of a vacancy at any time of the said
commissioners, either by refusal to act, death, or resignation,
or any other cause, the Levy Court of Prince George's county
shall, as soon as may be, fill such vacancy.

CHAPTER 74.
A further additional supplement to the act entitled, an act to establish
Pilots, and regulate their fees.

Section 1. Be it enacted by
the General Assembly of Maryland,
That hereafter every master of a merchant vessel, either
drawing nine feet water or upwards, or measuring one hundred
tons, (custom-house tonnage) coming from sea, shall be
obliged to receive the first pilot who offers below the Horse-Shoe,
