1829.
Black Water River to such point on the head of Parson's
Creek
in Dorchester county, as may be deemed most advantageous;
and to divert from their usual course the waters of any stream,
creek, or river, which they may think suitable for the purpose;
the said president and directors having first obtained the consent
of all persons having any right or interest in the same,
and also the consent of the owners of the land through which
such canal shall pass; or if such consent cannot be had, and
it be necessary that said canal should pass through the land of
any person whose consent cannot be had, the damages to be
paid by the company aforesaid, shall be assessed by a jury to
be summoned and empannelled by the sheriff of Dorchester
county, and upon application to the sheriff of said county, by
the president and directors aforesaid, it shall be his duty to
summon a jury of twelve persons, qualified as jurors of the
county court of said county, giving them and the owners of
the land, stream or water, to be assessed, at least eight days
previous notice of the time and place of a jury being empannelled:
Provided, that the canal shall not pass through the
house, garden, or orchard, of any person.

Sec. 7. And be it enacted,
That the President and Directors,
having paid to the owner of the land, stream, or water,
the sum so awarded by the Jury aforesaid, they shall have
power to cut, dig, and make the Canal as aforesaid, through
such land, stream or water, in the same manner as if the consent
of the owner had been given thereto; and the said President
and Directors shall have full power and authority to make
and dig such Canal along, under and across, any public highway,
for the purpose of conducting and conveying said water,
and for such purpose to dig, break up open at their
own expence, all, or any part of such highway, leaving at
all times a sufficient passage way for carriages, horses and
foot passengers, and restoring forthwith all such highway, to
good, perfect, and easy passage for horses, carriages, and
foot passengers, by good, substantial, and sufficient bridges,
over, and across said Canal, when it may intersect, cross, or
interfere with said highways.

Further authority
granted.

Sec. 8. And be it enacted,
That the said company shall be
subject to the same tax as all other incorporated companies
of this state, of similar kind.

An act to authorise Benjamin Chew, jun. of the city of Philadelphia,
to sell out of this state, certain negro slaves, who are
slaves for a term of years.

the General Assembly of Maryland,
That Benjamin Chew, jun. of the city of Philadelphia,
