1829.        LAWS OF MARYLAND.

  CHAP. 25.  
enjoined by law, according to the best of his skill and judgment,
without being influenced by favor, affection, hatred,
malice, or ill will; and that he will, in making all appointments
to office, vote for such person among those willing to accept
thereof, as in his judgment and belief shall be most capable
and best qualified to perform the duties of such office; which
oath shall be recorded in a book to be kept by the clerk,
among the records of Allegany county court.
Corporate powers.
    Sec. 3.  And be it enacted, That the commissioners elected
or appointed as aforesaid, and their successors, shall be, and
they are hereby constituted a body politic and corporate, by
the name, style, and title, of " The Commissioners of Allegany
county;" and by that name shall have continued and perpetual
succession, and be capable in law of suing and being sued,
of making and using a corporate [,] and of altering the same
at their pleasure; of taking, holding, selling, and conveying,
all kinds of estates, property, and effects, and of doing all and
every such act or acts, thing or things, device or devices,
needful or necessary to be done to the exercise of all powers
which are or shall be vested in them by this act, or by any
other act of Assembly, as fully and effectually, to all intents
and purposes, as corporate bodies may or can lawfully and
rightfully do.
    Powers of levy
court and commissioners
of tax conferred.
    Sec. 4.  And be it enacted, That when, and as soon as the
commissioners to be elected, or appointed as aforesaid, shall
have taken and subscribed the oath or affirmation hereinbefore
described, all the powers, rights, and privileges, lawfully exercised
by, and all property, estate, and effects, vested in the
justices of the Levy Court of Allegany county, shall be transferred
to, and vested in, the Commissioners of Allegany county,
who, or any of six of them, shall thereafter exercise all the
said powers, rights, and privileges, and shall perform all the
duties required to be performed by the said justices of the
Levy Court aforesaid; and no appointment of justices of the
Levy Court for Allegany county shall thereafter be made:  and
all the powers lawfully exercised by, or vested in, the commissioners
of the tax for Allegany county, and all the duties
required by law to be performed by them, shall be vested in,
and exercised and performed by, the said commissioners of
Allegany county, after the shall become qualified as aforesaid;
and no appointment of commissioners of the tax for Allegany
county shall thereafter be made.
Clerk.
    Sec. 5.  And be it enacted, That the commissioners of Allegany
county shall, at their annual meetings, appoint a well-qualified,
fit, and proper person, a resident of said county, to
act and serve as clerk to the said commissioners, who shall
transact all the business, and discharge all the duties, now appertaining
to the several and respective offices of clerk of the
Levy Court and commissioners of the tax, in the same manner
as the clerk of Allegany County Court, and the clerk of the
