CHAPTER 20.
An act to confirm certain proceedings of the Levy Court of Somerset
county, and for other purposes.
|
Preamble.
|
WHEREAS, by an act passed at December
session, eighteen
hundred and twenty, chapter twenty-one, the Levy Court of
Somerset county was authorised and required to release to
John King and other securities of a certain William S. Handy,
late collector of said county, such portions of a certain sum of
money which had been levied and assessed by virtue of an
act passed at December session, eighteen hundred and seventeen,
chapter seventy-four, and afterwards by an act passed at
December session, eighteen hundred and eighteen, chapter one
hundred and forty-six, directed to be appropriated to the payment
of the expences of the said county, as had been or might
thereafter be released by such owners of assessable property,
who had signed or might sign a written consent to such release;
and to appropriate the balance of said sum when recovered
from the said securities, to the expences of the said
county, and apply the same to the entire and exclusive benefit
of such owners of assessable property in said county as had
not or should not thereafter release:—

AND WHEREAS, from the revolutions in
the property and
population in said county since the year eighteen hundred and
eighteen, the Levy Court are unable to appropriate the balance
not released to the benefit of the owners of assessable
property, and in many cases to ascertain who are entitled to
any portion thereof, and it is unreasonable that the said securities
should pay any more of the said balance than shall be
demanded by persons entitled thereto:—

AND WHEREAS, the said Levy Court, in
the year eighteen
hundred and twenty-nine, gave public notice to all persons interested
in the said balance, to give notice of their intentions to
claim their proportion of the same, to the Clerk or the Attorney
of said Court by a given day, otherwise the said Court
would consider the same to be relinquished; therefore,

Proceedings confirmed.
Proviso.
|
Sec. 1. Be it enacted by the
General Assembly of Maryland,
That the proceedings of the Levy Court in the premises be, and
they are hereby confirmed: Provided nevertheless, That the
said Levy Court causes the said notice, so far as aforesaid
given, to be revived and continued until the first day of July
next, in a newspaper printed in said county, and by advertisement,
