the present road a little south of the point where the road
from William Penn's intersects said road.
Sec. 2. And be it enacted, That the said commissioners,
or a majority of them, are hereby authorised and empower-
ed to cause such road to be located and opened, and a plot
thereof to be made and returned to the clerk of the court of
Charles county, to be by him recorded; and the said road,
when located and opened, and the plot thereof recorded as
aforesaid, shall for ever thereafter be deemed a public high-
way, and kept in repair in the same manner as other public
roads in said county are kept in repair.

Sec. 3. And be it enacted, That the aforesaid commissi-
oners, or any two of them, shall ascertain and value what
damages, if any, may be sustained by the person or per-
sons through whose land the said road may pass, by open-
ing the same, and make return thereof to the levy court of
the county, who shall levy the same on the assessable pro-
perty of said county.

Sec. 4. And be it enacted, That all expenses incurred in
the locating, surveying, and opening the aforesaid road,
shall be defrayed in the same manner as other county charges

CHAP. XXI.

An Act to abolish the Levy Court and Commissioners
of the Tax for Anne-Arundel County, and for other
purposes.

Passed Feb 6, 1829

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, That from and after the passage of this act, it shall
be the duty of the governor and council, and they are here-
by required, annually to appoint seven of the best qualified
persons, citizens of Anne-Arundel county, one a resident
of each election district, and one of the city of Annapolis,
to be styled The Commissioners for Anne Arundel County;
and the persons appointed commissioners as aforesaid shall,
out of their own body, elect a president, and in case of the
death, resignation, refusal to act, or removal out of the
district of either of the commissioners appointed as afore-
said, the governor and council shall, at their next meeting,
supply the vacancy occasioned by such death, resignation,
refusal, or removal, as the case may be.

Sec. 2. And be it enacted, That every commissioner ap-
pointed as aforesaid shall, before he enters on the duties of
his office, take and subscribe, before some judge or justice
of the peace, an oath, or affirmation, that he will faithfully,
diligently and impartially, exercise the powers, and perform
the duties, of commissioners for Anne-Arundel county, as
authorised and enjoined by law, according to the best of
