CHAP. 127.

any year, then the said judges shall be entitled to the sum
actually received by the treasurer during that year, to be
equally divided among them, in addition to their permanent
salaries as aforesaid, and to no more, and any excess of the
amount so received by the treasurer, in any year, after the
payment of the said sum of eight hundred dollars to each
of the said judges, shall be and enure to the benefit of the
state.

An Act to Preserve the Breed of Fish in the Waters of the Ri-
ver Patuxent.

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, Thnt from and after the passage of this act it shall
not be lawful for any person or persons to whip, thresh or
beat, the waters of the Patuxent river, with any poles, oars,
paddles, ropes, or any other instrument, for the purpose of

lawful for any person or persons to stake down any seine or
net across the Patuxent river for the purpose of taking shad

Sec. 3. And be it enacted, That if any free person or per-
sons shall be guilty of any of the offences recited in this act,
he shall forfeit and pay tor each and every offence the sum of
twenty dollars, to be recovered before any justice of the
peace for the state of Maryland as other small debts are
recovered, one half to the use of the informer, the other
half to the state; and if committed by any slave or slaves,
he or they shall be taken before some justice of the peace
and be punished, in his discretion, not exceeding thirty-nine
lashes, unless the owner of such slave shall pay the fine
herein imposed for every ofience as aforesaid.
