Sec. 9. And be it enacted. That the said jurors shall re-

An Act to lay out and open a Road from the Town, of
Westminster, in Frederick County, to the eastern edge
of the Fording Place on the Western Fork of the Pa- .
tapsco Falls, near Wamplcr's Mills in Baltimore
County.

Sec. 1. Be it enacted by the General Assembly of Ma-
ryland, That Jacob Mathias and Michael Barnitz, of Fre-
derick county, and Thomas Smith and William Jordan, of
Baltimore county, be and they are hereby appointed com-
missioners to survey, lay out and open, a road not exceed-
ing thirty feet in width, in the best and straightest directi-
on, taking all circumstances into consideration, from that
part of Westminster, (at the commencement of the alley
heretofore left open by George Trumbo and Jacob Yingling
as a public alley,) to the eastern edge of the fording place
on the western fork of the Patapsco Falls near Wampler's
Mills, in Baltimore county, and the said commissioners
shall make out a plot of that part of the road through Frede-
rick county, and return the same to the clerk of the county
court, to be recorded among the records of said county, they
shall likewise make out a plot of that part of the road
through Baltimore county, to be recorded among the re-
cords of said county, and the said road when so opened,
shall be thereafter deemed to be a public road for ever, and
shall be kept in repair in the same manner as other public

Levy to be made

Sec. 2. And be it enacted, That the expenses of survey-
ing and opening the said road shall be paid by Frederick
and Baltimore counties, in proportion to the distance it may
pass through each county, and the levy court of Frederick
county, and commissioners for Baltimore county, are here-
by authorised and required, on receiving from the commis-
sioners an account, on oath, of the said expenses, including-
an allowance of two dollars par day to the commissioners
for their services, to levy the same in the proportion before
stated, on the assessable property pf said counties, to be
collected as other county charges are now collected.

Sec. 3. And be it enacted, That the said commissioners,
