CHAP. 100.

Vacancies how to

be supplied

Sec. 2. And be it enacted, That at all times forever
such community of trustees, by the death, resignation or
refusal, of any or more of the trustees thereof, or by wil-
ful neglect of any one or more of them to attend three suc-
ceeding stated meetings of the board of trustees, the sur-
viving or remaining trustees, or a quorum of them, may.
proceed to elect, by ballot, other sensible, judicious and
discreet person or persons, of the county or city of Balti-
more, to be the trustee or trustees to supply the vacancy or
vacancies occasioned by the respective causes aforesaid, and
in such manner may all future vacancy or vacancies be sup-
plied by the said truslees, and their successors, or a quo-
rum of them, so as to perpetuate not less than the number

and be sued, &c

of six persons of said academy or school forever.
Sec. 3. And be it enacted, That the said trustees, and
their successors, by the name and style aforesaid, shall be
capable in law to sue and be sued, plead and be impleaded,
in any court or courts, and before any judge, justice or
justices in this state, and elsewhere, in all manner of suits,
complaints, pleas, causes, matters and demands, of whatever
nature, kind or form, they be, and all and every other mat-
as any other person or persons, bodies politic, in like cases
may or can do and perform, and the said trustees, and their
successors, or a quorum of them, shall have full power and
authority to have, make and use, one common seal, with
such devices and inscriptions as they shall think proper,
and the same seal, at their pleasure, to create, alter and re-

be appointed

Sec. 4. And be it enacted, That the said trustees, and
their successors, or a quorum of them, from time to time,
and at all times hereafter, shall have full power and autho-
rity to constitute and appoint, in such manner as they shall
think best and most convenient, professors, teachers, and
assistants, for instructing the students and scholars of said
academy or school, in the languages and such sciences and
branches of education as they shall think proper and suitable
to be taught therein, and to make all such laws, ordinances,
rules, orders, or regulations, for the government of the said
academy or school, and the instruction of the pupils as afore-
said, and the directors, visitors, and examination of the said
seminary, and the scholars therein, as shall in their opi-
nion best promote the important objects of the institution,
provided the same be not repugnant to the constitution and
laws of this state.

Stated meetings

Sec. 5. And be it enacted, That the said trustees, and
their successors, or a quorum of them, shall meet at least
four limes every year in stated quarterly meetings, to be ap-
pointed by their own ordinances, or by their own adjourn-
