161-A. The Governor shall, biennially, before the Third
Monday in February, appoint by and with the advice and
consent of the Senate, if in session, and if riot in session, by
the Governor alone, in the City of Hagerstown, three persons
resident in and voters of said City of Hagerstown, two of
whom shall always be selected from the leading political
parties of the State, one from each of the parties, who shall
he men of approved integrity and capacity, and none of them
shall hold office or employment under the Government of
the United States or of the State of Maryland, and they must
not he candidates for office at the next ensuing municipal
election in the City of Hagerstown, or at any municipal elec-
tion in said city, within the term for which they or any of
them were appointed, who shall be styled the Board of Super-
visors of Election of the City of Hagerstown ; each of said
Supervisors shall hold office for two years from the date of
his appointment, and shall exercise the powers and perform
Hie duties hereinafter set forth ; in case of a vacancy occurring
in said Board when the Legislature is not in session, such
vacancy shall he filled by the Governor; it shall he the duty
of said hoard not later than the Third Monday of March in
each year, to appoint three persons for each ward of said
City of Hagerstown, residents in and voters of such ward,
who, or a majority of them, shall he judges of election for
such ward from the time of their appointment and until a new
appointment shall have been made; and it shall he the duty
of said Board in making the appointment of such judges of
election to select at least one of the said judges for each ward
from among those of the leading political parties different
from themselves or a majority of themselves; if any of the
said judges shall die, resign or remove out, of the ward for
which he was appointed, or become otherwise, in the opinion
of said Board. disqualified to act as such judge of election,
then the Board of Supervisors of Election shall appoint a
person as judge for the, ward in which each vacancy may
occur: the said Board of Supervisors of election shall record
every appointment so made in a book to be kept for that
purpose, and shall make out a warrant for such appoint-
ment and shall within two days thereafter deliver unto the
Chief of Police of the City of Hagerstown, under the penalty
of fifty dollars, who shall deliver such warrant to the person
appointed as such judge of election, or leave the same at his
