76 LAWS OF MARYLAND. [CH. 4.1

Article to follow immediately after Article 64, and to be
known as Article 64-A, and to be entitled "Merit System,"
and to contain 27 sections, numbers 1 to 27, inclusive, as fol-
lows :

ARTICLE 64-A.
MERIT SYSTEM.

1. In this Act and in all rules made hereunder, unless the
context otherwise requires—"Commissioner" means the State
Employment Commission. "The classified service" means
and includes all offices of profit or trust and all places of em-
ployment, whether permanent or temporary, in the service of
any State officer, department, commission, board or institu-
tion, other than those in the military forces, and other than
those enumerated in Section 2 of this Article. "Classified
service position" or "position" means any office or place of
employment in the classified service. "Classified service em-
ployee" or "employee" means a person who holds under the
terms of this Article, a position in the classified service, but
shall not include a person employed by contract to render a
temporary special service for the State where such contract
is certified by the State Employment Commissioner to be for
a service that could not in his judgment be rendered by a per-
son in the classified service. "Class of position" or "class"
means a group, established under this Act of positions similar
in respect to the duties and responsibilities thereof and the
qualifications required therefor. "Classification title," "class
title, or "title" means the designation given, under this Act,
to a class and to each position in the class and to the employee
in each position in the class. "Appointing authority" means
any commission, board or officer having power to make ap-
pointments.

2. The following positions shall not be included in the
classified service, namely: Those held by officers elected by
popular vote and officers whose appointment and election is
provided by the Constitution, including deputy clerks pro-
vided for by the Constitution, Article 4, Sections 26 and 37;
officers and employees of the General Assembly or of either
House thereof; officers and employees appointed or designated
by any court or judge thereof; deputies, assistants and em-
ployees appointed or designated by any Sheriff, any Register
of Wills, any Clerk of Court, any State's Attorney, or any
Board of Supervisors of Elections; supervisors of assessments
