request of such licensee shall have power to return the fees
paid by such licensee for racing upon the days upon which
it is impossible for such licensee to hold or conduct racing.

SEC. 2. And be it further enacted, That should any of the
paragraphs or parts of paragraphs contained in Section 1 of
this Act he held to he unconstitutional and void by the Court
of Appeals of this State, it is hereby expressly declared that
the remaining paragraphs or parts of paragraphs of said Sec-
tion 1 of this Act are not to be invalidated thereby, but are
to remain in full force and effect as if the paragraphs or
parts of paragraphs held unconstitutional had never been en-
acted.

SEC. 3. And be it further enacted, That all other Acts,
whether general or local, public or private, or previous grants
or franchises, inconsistent with the provisions of this Act
be and the same are hereby repealed, except as hereinbefore
provided.

CHAPTER 274.

AN ACT to repeal and re-enact with amendments Section 27
of Article 5 of the Public General Laws of Maryland, title
"Appeals and Errors," so as to provide for an appeal
from any order or decree affecting the custody of any
infant.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 27 of Article 5 of the Public General Laws
of the State of Maryland, title "Appeals and Errors." be and
the same is hereby repealed and re-enacted with amendments
so as to read as follows, that is to say:

SEC. 27. An appeal may also be granted in the following
cases, to wit: From any order granting an injunction, or from
a refusal to dissolve the same, or an order appointing a re-
ceiver the answer of the party appealing being first filed in
the cause: from an order dissolving an injunction; from an
order for the sale, conveyance or delivery of real or personal
property, or the payment of money, unless such delivery or
payment be directed to be made to a receiver appointed by
such court; or from any order determining a question of right
between the parties, and directing "an account to be stated
