and for such other reasons as may be provided for by the
laws of this State and of the United States.

39. Enlisted men may be transferred, in the same organi-
zation by the commanding officers of such organizations; from
one organization to another, by a commanding officer of the
Brigade; or from the Brigade to the Naval Brigade, or vice
versa, by the Commander-in-Chief. All such transfers to be
approved by the commanding officers of the respective or-
ganizations.

40. All discharges of enlisted men shall be made under
the same rule and regulations as discharges are made in the
United States Army or Navy; or as are adopted from time to
time by the Governor; provided, an enlisted man who has not
returned all the public or military property for which he is
responsible shall under no circumstances, receive au honor-
able discharge.

41. For all the purposes of this Article, officers and en-
listed men of the Active Militia or National Guard who en-
tered the military or naval service of the United States in
the Spanish-American or subsequent wars, shall be entitled
to credit for the time served in such service as if the service
had been rendered in the Active Militia.

42. The officers commanding the Brigade and Naval Bri-
gade may cause those under their command to perform any
military duty, and shall be responsible to the Governor for
the general efficiency of the National Guard and for the drill,
inspection, small arms and artillery practice, movements,
operations and care of troops. Commanding officers of organi-
zations shall be responsible to their immediate commanders
for the equipment, drill, instruction, movements and efficiency
of their respective commands. All commanding officers and
enlisted men shall be responsible to their immediate com-
manding officers for prompt and unhesitating obedience,
proper drill and the preservation and proper use of the prop-
erty of State and of the United States or organization in their
possession. The Brigade and Naval Brigade shall be inspected
not less than once a year, and oftener, in the discretion of the
Commander-in-Chief.

43. Officers and enlisted men may be warned for duty as
reading the order to the person warned, or by leaving a copy
of such order at the last known place of abode or business,
