years or more he shall receive an honorable discharge, pro-
vided he shall not be under arrest or return to a military court
for any deficiency or delinquency; and, provided further, he
be not indebted to the State in any manner, and that his ac-
counts for money or for public property be correct. In com-
puting the time he served, service as an enlisted man shall be
allowed, and the service is not required to be continuous. If
the Governor accept the resignation of an officer who at the
time shall be under arrest, under charges, or returned to a
military court for any offense, deficiency or delinquency,
such officer shall then cease to be an officer of the Organized
Militia or National Guard, and shall receive a discharge in
such form as the Governor shall direct; nor shall he be again
eligible to receive a commission unless he first re-enlist as
provided in this Article in the case of men dishonorably dis-
charged, and until he shall have performed at least sixty per
cent of duty in each year under such enlistment for two suc-
cessive years.
30. There shall be a National Guard Reserve to consist of
such officers and enlisted men as are prescribed and provided
for by the rules and regulations of the War Department of the
United States Government.
31. There shall be a Retired List exclusively restricted to
officers and enlisted men of the National Guard and none
other, to be known as the "Maryland National Guard, Re-
tired," and those placed thereon shall be subject to the same
restrictions as are enjoined by the Retired Lists of the United
States Army in so far as the same are applicable. Any officer
or enlisted man who has reached the age of 64 years shall be
placed upon the Retired List and any officer or enlisted man
who has been in the active military service of the State for a
period of fifteen years may, upon application, be relieved
from active duty and placed upon the Retired List and, also,
those who from physical disability, or change in residence
after ten years' active service become incapable of perform-
ing their duties. All officers and enlisted men as above set
forth shall be placed upon the Retired List by the Governor
and Commander-in-Chief.
32. The Governor may, upon the recommendation of their
commanding officers (approved by the Brigade Commander
or Commander of the Naval Militia) confer brevet commis-
sions of a grade next higher than the ordinary commission
