does not or do not conform to the particular bond or
bonds of conveyance, on which said deed or deeds shall
or may be Founded, then the deed or deeds for such one
or more of said pieces or parcels of land, in respect of
which the bond of conveyance or bonds of conveyance
shall be infected with fraud, or in respect of which the
deed or deeds shall not conform to the bond of convey-
ance or bonds of conveyance, as the case may be, shall
be ineffectual to pass any title or estate whatever, and
shall be wholly void and of no effect in law.

CHAP. T9.

SEC. 2. And be it enacted, That any deed or deeds
which shall be so executed under the provisions of the
foregoing section, shall be deemed and taken to be, in
all courts of justice and elsewhere, as valid and opera-
tive, to all intents and purposes, as if die same had
been executed by the said John Murray in his lifetime,
subject, nevertheless, to the provisions and conditions
specified in the foregoing section.

CHAPTER 79.


An act to authorise the Franklin Rail Road Company,
Incorporated by the State of Pennsylvania, to extend
their -works within the limits of the State of Mary-
land.

1837.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That from and after the passage of this
act, it shall and may be lawful for the Franklin Rail
Road Company, incorporated by the Legislature of the

Privilege grant-
ed

Commonwealth of Pennsylvania, to locate, construct
and establish a Rail Road of no greater width than the
Baltimore and Ohio Rail Road, with one or more
tracts of the same width, as the tracts of the Balti-
more and Ohio Rail Road, from a point in the line of
the State of Pennsylvania, bordering on Washington
county, in the State of Maryland, to connect with the
Baltimore and Ohio Rail Road, and the Chesapeake
and Ohio Canal or either of them, if only one be actu-
ally constructed in the course of the proposed line of
said Franklin Rail Road, at the time of its construction,
at or near Hagerstown or Williamsport, or between
those places, as the said company may deem more advi-
