CONSTITUTION &c.— The person voted for as senator
anil having the largest number of votes, and
being qualified as herein mentioned in each
county and the city aforesaid, shall be de-
clared and returned as duly elected for

said city or county,
If two persons in &c. shall have an
equal number of voles, there shall be a
new election ordered, as hereinafter men-

tioned,
Immediately after convening, the sena-
tors so elected, shall be divided in such
manner as the senators shall prescribe,
into three classes, the teats of the first of
which shall be vacated in two years, of
the second in four, and of the third in six
years, so that one third thereof may be
elected on the first Wednesday in October
|
|
|
|
|
in every second year,
Elections shall be held in the several
counties and city from which the retiring
|
|
|
|
|
Elections for senators to be conducted,
returns made &c. as in elections for dele-
|
|
|
|
|
gates.
Qualification necessary in a senator,
the same as in a Delegate tn the General
Assembly, with the additional requisite,
that he shall be above the age of twenty
five, and sliall have resided for three years
next preceding his election, in the city or

county for which he shall be chosen,
In case of a person chosen refusing tn act,
removing from county &c. die, resign, or
be removed for cause, or in case of a tie
between two or more qualified persons in
any one. of the counties &c. a warrant
shall be issued by the president of the

senate, for an election to supply the place,
Of which election ten days notice ex-
clusive of the day of election, shall be
