CHAP. 289.

that the said county is indebted to him in a sum of mo-
ney for services as messenger to the county court of
said county, which the levy court of said county has
refused to pay on the ground that the said sum is not
due, and the said Benjamin Simpson being desirous to
establish and recover the said claim by a suit at law,
Therefore,

Suit authorised
|
Be it enacted by the General Assembly of Maryland,
That Benjamin Simpson, of Prince George's county
be, and he is hereby authorised and empowered to in-
stitute a suit against the levy court of Prince George's
county, for the recovery of the claim aforesaid against
the said county by causing proper process to be issued
against the said levy court, and served on the members
thereof; and all proceedings may take place for the
purpose of prosecuting and defending said suit, which
are now authorised in cases between parties to suits at
law.

An act relating to Appeals.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That in all cases hereafter of records trans-
mitted to the court of appeals of the Western or East-
ern Shore of this State, it shall be the duty of the clerk
or register transmitting the same, to make upon the
record so transmitted, the amount of the costs taxed
against the plaintiff and defendant respectively to the
time of the appeal.

SEC. 2. And be it enacted, That when any instrument
of writing has been once transcribed into any record so
intended to be transmitted, it shall not be necessary to
copy such instrument a second time in such record,
and if copied a second time contrary to the provisions
of this act, the parties concerned in the cause shall not

be charged for such second copy by the said clerk or
register so transmitting the same; and that wben the
same written instrument is introduced a second time
into any such record, it shall be sufficient to refer to
the same, and the page of its first introduction into the
record generally.
