An act to authorise the laying out and opening of a road
in Montgomery and Frederick counties.

Preamble

WHEREAS, many citizens of Montgomery and Fre-
derick counties, by their petition to the General As-
sembly of Maryland, have represented that a road from
Hyatts town, in Montgomery county, to Barnesville,
in said county, and passing in its course through apart
of Frederick county, would be greatly conducive to
the public convenience, — Therefore:

Commissioners
to lay out and
open

SECTION 1. Be it enacted by the General Assembly of
Maryland, That William Pearce, Samuel Soper and
Walter Hodges, of Montgomery county, and Addison
White and Zachariah T. Windsor, of Frederick coun-
ty, be and they are hereby appointed commissioners to
view, locate and lay out said road if in their judgment
the public convenience requires the same to be laid out
and opened.

Their duties, &c

SEC. 2. And be it enacted, That in the execution of
the power, and the performance of the duties confercd
and imposed by this act, the said commissioners shall
be governed by the several provisions of the act of
Assembly, passed at December session, eighteen hun-
dred and eighteen, chapter eighty-nine, entitled, an
act to regulate the manner of obtaining and altering
public roads in this State.

SEC. 3. And be it enacted, That the said commission-
ers shall make return of their proceedings as is provid-
ed by the first section of the act aforesaid, to the county
courts of Montgomery county and Frederick county,
and in their said return they shall distinctly set forth
what part of said road is in each of said counties, and
the damages assessed in each county respectively, and

said courts shall have the power to revise, amend, con-
firm or reject said return in the same manner as is pro-
vided in the fifth and sixth section of the act aforesaid;
