CHAP. 33.

before a justice of the peace, well and faithfully, and
without partiality, prejudice, favourer affection, and
according to the best of their skill and judgment, to
execute and perform the duties herein imposed upon
and required of them.

Case of vacan-
cy.
|
SEC. 3. And be it enacted, That if any of the com-
missioners named in this act, shall by death, resigna-
tion or removal out of said county, or from any other
cause fail to perform the duties of his appointment, the
remaining commissioners or a majority of them, as the
such vacancy or vacancies, having regard to the loca-
tion of the individual or individuals through whom the
vacancy or vacancies may take place.

ed, &c.

SEC. 4. And be it enacted. That the said commiss-
ioners or a majority of them, appointed by virtue of
this act. shall meet forthwith in the town of Westmin-
ster, at such place as a majority of them may desig-
nate, for the purpose of performing the duties imposed
by this act, and they or a majority of them so meeting
may adjourn from time to time and place to place, un-
til the. whole is completed.

Surveyor.
|
SEC. 5. And be it enacted, That the said commiss-
ioners or a majority of them, be, and they are hereby
veyors, chain carriers and polls men, to lay off, mark,
and bound said districts, and that the said commission-
ers each, shall receive two dollars a day. surveyor or

surveyors two dollars a day each, and chain carriers
and pollsmen each a dollar a day, for each day they
may be engaged in such service, to be levied, collected
and paid as all other county charges are.
