18 ~  Court convenes; Commissioners present: Francis Jenckins, Capt. William Whittington, Samuel Hopkins, Thomas Jones, Capt. John King.

 

18 ~  Petition of Robert King to be discharged from administration of estate of John Galbraith, now complete and forwarded to Commissary’s office; paid out more than appraised value of estate; granted.

 

18 ~  John Cole of Accomac (Accamack). Innholder, Pltf. vs. Teague Riggen, Sen., Deft. for debt of 4700 lbs/tbco; Peter Dent, attorney for Cole, presents note of debt signed 21 November 1691 by Riggen, witnesses William Martiall, William Yeo, William Buntin; Samuel Alexander, attorney for Riggen, cites Act of Assembly declaring null and void all bills from ordinary keepers not in conformance with the act; Court rules for Cole as declared.

 

19 ~  Petition of Martin Trentham asks Court to administer oath to him as Subsheriff to Ephraim Wilson; granted; Trentham to take Oath of Abhorrence and Oath for undersheriff.

 

19 ~  Case against Margaret Drue for stealing a diamond ring of Capt. Henry Smith; Drue pleads not guilty; Jury called; Richard Chambers (foreman), William Planner, Sen., John McKnitt, Robert Smith, William Law, William Alexander, Jun., William Curre, Francis Joyce, Richard Holland, William Lawrence, John Mcbride, Stephen Costine; Jury finds Drue guilty, values the ring at 100 lbs/tbco; Court orders Smith to pay fees for Margaret Drue; Peter Dent Clerk of Indictments.

 

20 ~ George Layfield, Pltf. vs. George Latcham, Deft. for 381 lbs/tbco due to estate of Col. William Stevens, for which Layfield’s wife Ann, widow of Stevens, is executrix; Peter Dent, attorney for Layfield, presents note signed 28 February 1686 in Pocomoke by Latcham promising payment by 10 March following; witnesses John Loder, Edmund Howard; Samuel Worthington, for Latcham, presents note signed by John Smocke for tobacco received from Latcham for credit of Stevens; Court rules a non-suit.

 

21 ~ George Layfield, Pltf. vs. George Latcham, Deft. for 500 lbs/tbco due estate of Col. William Stevens, for which Layfield’s wife Ann, widow of Stevens, is executrix; Peter Dent, attorney for Layfield, presents account from 26 March 1687 for sundry goods delivered to Latcham; Samuel Worthington, for Latcham, says that Layfield should have provided defendant a bill; evidences, James Sangster, Law. Gary; Court rules a non-suit.

 

22 ~ George Layfield, Pltf. vs. William Lawrence, Deft. for one thousand pounds of “good fat beef with the tallow” due estate of Col. William Stevens, for which Layfield’s wife Ann, widow of Stevens, is executrix; Peter Dent, attorney for Layfield, presents note signed 7 July 1681 by Lawrence promising delivery to Snow Hill by 1 October following; witnesses; Walter Lane, Edmund Howard; Samuel Worthington, for Lawrence, acknowledges debt, but says it was paid, presents two receipts signed by Oliver Berry & William Johnson on behalf of Stevens; Court rules account is balanced; no cause for action.

 

23 ~  Andrew Worthington, Innholder & Richard Chambers, blacksmith, Pltfs. vs. Jonathan Towers, Deft. for 2864 lbs/tbco due from estate of William Galt, deceased, shoemaker, for which Tower’s wife Margarett, widow of Galt, is executrix; James Sangster, attorney for plaintiffs, says the amount is 2/3 of the estate, valued at 4295 lbs/tbco; Samuel Alexander, attorney for Towers, says he is not responsible; Sangster argues he is also executor, by law; Court rules for plaintiffs, balance due of 2504 lbs/tbco.

 

24 ~  Capt. William Whittington enters his assent to Courthouse at Dividing Creek. (already approved by other Commisioners; see 1692-93 Judicials, f.247)

 

24 ~  Robert Miller requests payment for 4 days attendance at Court, case of Worthington & Chambers vs. Towers.

 

24 ~  Sampson Wheatley requests payment for 4 days attendance at Court, case of John Kirke vs. George Wilson.

 

24 ~  Samuel Marchment requests payment for 2 days attendance at Court, case of Thomas Jones, vs. Richard Wharton.
