200 ~  Court convenes; Commissioners present: Francis Jenckins, James Dashiels, Samuel Hopkins, Capt. John Winder, George Layfield, Capt. John King.

 

200 ~  Petition of Archibald Smith for custody of plantation of John Trubshaw, deceased, whose son and heir, John Trubshaw, aged three, is ward of Smith; Court grants petition subject to conditions on Smith maintaining and improving the plantation until Trubshaw comes of age.

 

201 ~  Bond on Archibald Smith for £50 to maintain and improve the plantation of John Trubshaw; specific conditions include planting of apple, quince and pear trees and not selling parts of plantation; securites: Thomas Smith, John Browne.

 

201 ~  Alexander Killock, Pltf. vs. William Keens, Deft. for 2000 lbs/tbco as recompense for 45 bushels of Indian corn which Killock had given Keens to sell in 1687, but which he claims Keens had used for himself; Samuel Alexander, attorney for Killock presents note signed by William Keens, Sen. dated 13 June 1692; in note Keens (Sen.) states that the corn for which Sanders Calah is suing his son, Keens (Jun.), was lost due to Calah’s own neglect; Peter Dent, attorney for Keens, denies charges; Jury called by Sheriff: James Curtis (foreman), Alexander Thomas, Lawrence Gary, James, Langreen, Moses Fenton, Richard Cary, Somerset Dickinson, John Gray, Roger Odowey, Thomas Smith, William Wallace (Wallis), Esau Boston; Jury finds for Killock in amount of 11 bushels of corn; Keens to pay, with costs.

 

202 ~  James Barry, Pltf. vs. Peter Whaples, Deft. for debt of 1600 lbs/tbco due from 1690 for 7 hides and 3 pairs shoes; John Strawbridge attorney for Barry; Whaples denies charge; evidences: George Benson & wife Ann, Roger Burkam, Sam Worthington; Court rules for Barry, as declared, Whaples to pay costs.

 

203 ~  John Rowell, Pltf. vs. William Matthews, Deft. for 1840 lbs/tbco due for six cattle and other items taken from Rowell’s farm; John Strawbridge, attorney for Rowell, states that in Rowell’s absence Matthews had offered to brand and look after cattle for his wife, to which she agreed, but Matthews afterwards kept them for himself; itemized bill for cattle and other items totaling 1840 lbs/tbco entered in record; Matthews denies charges; Jury called: Miles Gray (foreman), John Kellam, John Jones, John Starlin, George Lane, Samuel Johnson, Anthony Jones, Thomas Gillett, William Keens, Henry Freakes, John Renshaw, William Wouldhave; evidences for Rowell: William and Mary McMillion; for Matthews: Teague Riggen, Jun., Esau Boston; Jury finds that Matthews should return like cattle to Rowell; Court deducts for two dead cattle, but orders the rest, plus costs.

 

205 ~  John Rowell,cordwinder, Pltf. vs. Hope Tayler, Deft. for 600 lbs/tbco for 12 yards of cloth that Tayler was supposed to weave from parcel of yarn provided him by Rowell’s wife Margarett, about 15 March 1691 in Marumsco, payment for which was to be a pair of shoes or bushel of salt; John Strawbridge, attorney for Rowell asserts that Tayler sold the yarn; Tayler concedes; ordered to pay as declared, and Rowell to give him a pair of shoes or bushel of salt.

 

206 ~  Nicholas Lisney, Pltf. vs. Richard Maclure, Deft. for debt of 400 lbs/tbco; Peter Dent, attorney for Lisney, presents note of Debt signed by Maclure 1 February 1691/2 in Pocomoke; Maclure admits debt; ordered to pay with costs.

 

207 ~  Robert Hearn of Manokin, Pltf. vs. Lawrence Crawford of Pocomke, Deft.  for debt of 1756 lbs/tbco; Peter Dent, attorney for Hearn, presents note dated 28 April 1691 signed by Crawford, witnessed by John Emmett, Patrick Reed; Crawford does not appear; Court rules for Hearn; Crawford to pay costs.

 

208 ~  John Chin, Pltf. vs. David Griffis, Deft. for non-delivery of 5000 8-penny nails; Peter Dent, attorney for Chin, cites note dated 13 October 1683, claims Griffis promised delivery by 20 December 1684; Court notes that no bill presented; rules a non-suit.

 

208 ~  John Chin, Pltf. vs. David Griffis, Deft. for non-delivery of 9000 8-penny nails and 1000 20-penny nails, per note signed 13 October 1683 for delivery by 1 March following; same result.
