26 ~  Court convenes; Commissioners present: Francis Jenckins, Thomas Newbold, George Layfield, Thomas Dixon, Arnold Elzey, Matthew Scarbrough, James Round, Capt. John King, Samuel Hopkins, Thomas Jones.

26 ~  Letter from Governor Francis Nicholson to Edward Green dated 21 August 1695; appoints Green as Chief and Only Officer for disposing of drift whales and wrecks on the seaboard side. (See Transcription)

27 ~  John Upshott does not appear in court due to sickness; his bond continued to next Court.

27 ~  Rose Mason appears but has no security; put into Sheriff’s custody.

27 ~  Robert Pirrie, Pltf. vs. Henry Reed, cordwinder, & wife Perthenia, Admx of John Smock, Defts. for debt of 400 lbs/pork and 300 lbs/tbco; Pirrie claims debt contracted at Snow Hill in 1690; Samuel Alexander, attorney for Reed, claims they have administered the debt; Pirie denies; Court rules a non-suit.

28 ~  William Smullen, Pltf. vs. Jeremiah Harris, Deft. for 2800 lbs/tbco damages for not erecting a forty foot tobacco house for Smullen at Parrahawkin; Peter Dent, attorney for Smullen, claims Harris agreed on 28 July 1693 to construct the house for 800 lbs/tbco and received 400 lbs/tbco credit from Smullen; Sam Worthington claims improper suit because John Barber was also party to the agreement but not sued; Court awards Smullen 200 lbs/tbco.

29 ~  Samuel Marchment, Pltf. vs. Ralph Milbourn, Deft. for debt of 1500 lbs/tbco; Samuel Alexander, attorney for Marchment, claims debt is due for 900 feet of white oak plank provided Milbourn at Pocomoke; in 1693; Robert Pirrie, for Milbourn, denies claim; Court considers debt not proven, rules a non-suit.

30 ~  George Layfield, Esg., Pltf. vs. Benjamin Deards, sawyer, Deft. for 16,000 lbs/tbco damages for stolen timber; Samuel Worthington, attorney for Layfield, claims Deards took cypress lumber in 1693 from Layfields property, Little Convenience, obtained from Thomas and Sarah Miller; Court considers that it does not have jurisdiction; rules a non-suit.

30 ~  George Layfield, wife Elizabeth, Extrx for Col. William Stevens, Pltf. vs. Edward Jones. Deft. for debt of 1180 lbs/tbco; Sam Worthington, attorney for Layfield, presents bill of debt signed 28 August 1686 by Jones promising delivery to Col. Stevens by following 10 November; Jones admits debt; Court orders payment, with costs.

31 ~  John Vigerous, Pltf. vs. John Willson, Deft. for debt of 600 lbs/tbco; Robrt Pirrie, attorney for Willson, admits debt; Court orders payment.

31 ~  Ellis Coleman, Pltf. vs. Charles Williams, planter, Deft. for debt of 1124 lbs/pork; Robert Pirrie, attorney for Coleman, presents note signed by Williams 19 April 1692 promising payment at Snow Hill by following  31 October; witnesses Henry Stevenson, Henry Selbey; Samuel Alexander, for Williams, pleads none age; Pirrie asserts that “if it is for meat, brink or apparel, it is no plea in Barr”; Court rules a non-suit.

32 ~   Ephraim Wilson, Pltf. vs. Moses Fenton, Deft. for debt of 965 lbs/tbco; Peter Dent, attorney for Wilson, presents account from 1693 for various items of cloth and clothing, also an account for Wilson’s services as Sheriff (including 120 lbs/tbco for “whipping two whores”); Court considers that Fenton owes a balance of 610 lbs/tbco; orders payment.

32 ~   Ephraim Wilson, Pltf. vs. Moses Fenton, Deft; declaration not signed or pledges subscribed; Court rules a non-suit.

33 ~  Thomas Jones, Pltf. vs. William Clark, dec’d; Jones and Samuel Alexander required to post 2000 lbs/tbco security on attacment of goods from Clark’s estate.

33 ~  George Layfield, Esq., Pltf. vs. William Tomkins; after some debate, matter was referred to Capt. John Cornish and Walter Lane for arbitration; to report at next court.

33 ~  William Warrick requests payment for twelve days attendance at Court; case of William Smullen vs. Jeremiah Harris.

33 ~  William Densem requests payment for fourteen days attendance at Court; case of William Smullen vs. Jeremiah Harris.

33 ~  Richard Shockley requests payment for ten days attendance at Court; case of William Smullen vs. Jeremiah Harris.

33 ~  Dennam Olondman requests payment for five days attendance at Court; case of James Barry and John Rowell.

33 ~ John Barber requests payment for nine days attendance at Court; case of William Smullen vs. Jeremiah Harris.

33 ~  Bond for £100 made 4 May 1693 on Thomas Hill, mariner of Boston, for conveyance of two Negroes, Ned & Robin, to Thomas Jones of Annemessex; witnesses John Brown, Robert Prentis, Elinor Sample; attested before Thomas Dixon on 9 September 1695.
