whether such person is at the time of such inquiry insane or
lunatic, or of such mental incapacity as to prevent such person
from properly conducting his or her defense or advising as to
the conduct of his or her defense; and if the lunacy commis-
sion shall find that such person is at the time of such inquiry
insane or lunatic or of such mental incapacity as to prevent
such person from properly conducting his or her defense or ad-
vising as to the conduct of his or her defense, the court shall
in its discretion direct such person to be confined in one of the
institutions referred to in the preceding section, until he or she
shall have recovered and shall stay the proceedings against such
person until that time, and upon recovery the court shall pro-
ceed with the trial of the charge pending against such person.
The inquisition by said lunacy commission shall be made in the
same manner and under the same conditions as examination of
convicts are now required to be made by the said lunacy com-
mission when summoned to do so by the Board of Directors of
the Penitentiary or House of Correction pursuant to the pro-
visions of Chapter 715 of the Acts of 1910, codified as Section 44
of Article 59 of the Code of Public General Laws of Maryland
of 1910.

SEC. 2. And be it further enacted, That this Act shall take
effect from and after the first day of June, 1916.

CHAPTER 700.

AN ACT to repeal and re-enact with amendments Section 2-1-5
of Article 16 of the Code of Public Local Laws of Mary-
land, title "Montgomery County, " sub-title "Garrett Park, "
as the same was enacted by Chapter 790 of the Acts of the
Genera] Assembly of Maryland, 1912.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 245 of Article 16 of the Code of Public Local
Laws of Maryland, title "Montgomery County, " sub-title
"Garrett Park, " as the same was enacted by Chapter 790 of
the Acts of the General Assembly of Maryland, 1912, be and
the same is hereby repealed and re-enacted with amendments
to read as follows:

SEC. 245. The boundaries of said town shall embrace the
several Garrett Park sub-divisions of the lands of the Metro-
politan Investment and Building Company of Montgomery
