SEC. 2. And be it enacted, That this Act shall take effect
October 1st, 1916.

CHAPTER 699.
AN ACT to repeal and re-enact with amendments Sections 4:
and 6 of Article 59 of the Code of Public General Laws of
Maryland, of 1888, codified as Sections 4 and 6 of Article
59 of the Code of Public General Laws of Maryland of
1910, title "Lunatics and Insane, " sub-title "Insanity as a
Defense in Criminal Cases. "
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 4 and 6 of Article 59 of the Code of Public
General Laws of Maryland of 1888, codified as Sections 4 and 6
of Article 59 of the Code of Public General Laws of Mary-
land of 1910, title "Lunatics and Insane, " sub-title "Insanity
as a Defense in Criminal Cases" be and the same are hereby
repealed and re-enacted with amendments so as to read as
follows:
SEC. 4. When any person indicted for a crime, offense or
misdemeanor shall allege insanity or lunacy in his or her de-
fense, the jury impaneled to try such person shall find by their
verdict whether such person was at the time of the commission
of the alleged offense or still is insane, lunatic or otherwise.
The judge of the court in which such indictment is pending
shall have full power and authority at any time before trial
to order an examination of the mental condition of such person
by the lunacy commission, which examination shall be made in
the same manner and under the same conditions as examina-
tions of convicts are now required to be made by the said lunacy
commission when summoned to do so by the Board of Directors
of the Penitentiary or House of Correction, pursuant to the
provisions of Chapter 715 of the Acts of 1910, codified as Sec-
tion 44 of Article 59 of the Code of Public General Laws of
Maryland of 1910.
SEC. 6. Whenever any person charged with the commission
of any crime, offense or misdemeanor shall appear to the court
or be alleged to be a lunatic or insane, or if the court shall
have any reason to suspect that such person may be a lunatic or
insane the court may cause the lunacy commission 'to inquire
