(4) Maximum Speed.
No motor vehicle shall be operated upon any highway of
this State at a rate of speed greater than thirty-five miles per
hour under any circumstances or conditions.
(5) Penalties.
Any person violating any of the provisions of sub-sections
(1), (2) or (3) of this section shall be deemed guilty of a
misdemeanor and subject to a fine of not more than fifty dol-
lars ($50. 00) for each first offense. Any person operating a
motor vehicle upon any highway of this State at a rate of
speed greater than thirty-five miles per hour, shall be deemed
guilty of a misdemeanor and subject upon conviction to a fine
of not less than twenty-five dollars ($25. 00) or more than one
hundred dollars ($100. 00). Any person so convicted shall also
be subject, in the discretion of the Commissioner of Motor
Vehicles, to a suspension of his operator's license for not less
than three months, if, upon a hearing had after notice as else-
where provided in this sub-title, the Commissioner of Motor
Vehicles shall determine that such rate of speed was in fact
exceeded.
When Speed to be Reduced.
150. Upon approaching any person walking in the trav-
eled portion of any public highway or a horse or any ani-
mal being led, ridden or driven thereon, or a crossing of inter-
secting public highways, or a bridge or a sharp turn, or a curve,
or a deep descent, and also in passing such person or such
horse or other animal, and in traversing such crossing, bridge,
turn, curve or descent, and in approaching or about to pass or
passing a street car which has stopped or about to stop to re-
ceive or discharge passengers, the person operating a motor
vehicle or motor-cycle shall have the same under control and
shall reduce its speed to a reasonable and proper rate. If such
horse or other animal being so led, ridden or driven shall ap-
pear to be frightened, or if the person in charge thereof shall
signal so to do by raising his or her hand vertically, the per-
son operating such motor vehicle or motor-cycle shall bring the
same to a stop, and if traveling in the opposite direction shall
remain stationary so long as may be reasonable to allow such
horse or other animal to pass, or if traveling in the same direc-
tion, shall use reasonable caution in thereafter passing such
horse or animal, but no person shall give such a signal to stop
