judgments of the justices of the peace mentioned in this sec-
tion, appeals may be taken on the terms mentioned in the next
preceding section.
262. The possession, between the fifteenth day of October
and the thirty-first day of December of each year, of any net
or trap, used or contrived for the purposes forbidden by sec-
tion 259, shall be prima facie evidence against its possessor of
its being possessed for the purpose of violating that section.
263. Nothing in Section 259 shall be construed to pro-
hibit the use, as now by law allowed, of what are known as
hauling seines, when laid out from and landed on the shore.
264. It shall not be lawful for any person to fish with
seine, gill nets, fykes, traps or set nets of any kind or descrip-
tion within the waters of Gunpowder and Bush Rivers in
Harford County, except from the 15th of September to the
15th of May in each year.
265. Any person violating the provisions of the preceding
Section shall be guilty of a misdemeanor, and shall be pun-
ished by imprisonment for not more than six months or less
than three months, or fined not more than three hundred nor
less than ten dollars for each and every violation in the discre-
tion of the court.
266. Any sheriff or constable who shall be satisfied, either
upon his own view or from information received from any
other person on oath, that any person has violated the pro-
visions of the preceding Sections, is empowered to arrest the
offender.
267. It shall be unlawful for any person to fish by haul-
ing seine, or to haul seine in the waters of Bush river, or any
of its tributaries, in Harford County.
268. It shall not be lawful for any person not a bona fide
resident of the County to fish in the waters of the Bush river
and Gunpowder river, in the county of Harford, with pound
nets, fike nets, stake nets, hoop nets, gill nets, purse seine,
buck nets, haul seine or any trap or net of any kind of de-
scription, except with hook and line; provided, however, that
nothing herein contained shall prevent owners, renters or les-
sees of farms and lands bordering upon the waters of said
rivers from catching fish with nets in said waters.
269. Each and every person violating any of the provi-
sions of the preceding section shall be subject to arrest by any
person authorized by law to make the same, or upon a war-
