Mayor and Council of Hagerstown be and it is hereby au-
thorized and empowered to condemn the said property, tract or
tracts of land with improvements thereon together with the
stream of water known as "Marsh Run" from the eastern
boundary of the property of the Hagerstown City Park to the
Antietam Creek and all streams of water, water-ways, water-
courses, drains and sewers emptying into the said stream of
water known as "Marsh Run" aforesaid and all the rights, ease-
ments, ways, privileges and water rights of every kind and
description whatsoever of all persons and corporations claiming
or owning any and all such rights therein or in any wise apper-
taining thereto, and the proceedings of condemnation shall be as
provided by Article 33A of Chapter 463 of the Acts of the Gen-
eral Assembly of Maryland passed at its January Session, 1914.

SEC. 3. And be it enacted, That the Mayor and Council of"
Hagerstown after the amount of the purchase money has been
fully and finally determined and agreed upon for said property
and all property rights, streams of water, drains and sewers and
rights therein with the owners thereof or after the amount has
been awarded to the said owners under and by virtue of the
condemnation proceedings set forth in Section 2 of this Act, if
the said award be accepted by the said Mayor and Council, shall
levy a sum of money upon the assessable property of Hagers-
town sufficient to pay for the said tract or tracts of land and im-
provements thereon together with all streams of water, ease-
ments, sewers, drains, water-ways, water rights, water courses
and the rights therein of all persons and corporations or in any
wise appertaining thereto so agreed upon or awarded in said
condemnation proceedings, at the time of the making of the
annual levy of taxes by the said Mayor and Council and to be
included therein.

SEC. 4. And be it enacted, That after the completion of
said purchase or the acceptance of the award by condemnation
of said land and the title thereto has been fully acquired, as
aforesaid, the Mayor and Council of Hagerstown shall be of
the opinion that any part of said lands and property are un-
necessary for the complete and proper carrying out of the pro-
visions of this Act the Mayor and Council of Hagerstown is
hereby authorized and empowered to sell and dispose of any
such part thereof for the best price obtainable, the proceeds
arising therefrom to be credited by the Mayor and Council to
the General Purpose Account Fund, the same to be paid out
