956 LAWS OF MARYLAND.

24. That the Corporation shall assume the supervision of
all public highways in said town to keep the same repaired and
they shall have power to repair, widen or extend the same, lay
out new streets and open the same, condemn rights of ways or
acquire the same by purchase, assess damages in the premises

and pay the same out of any moneys in the treasury not other-
wise appropriated, according to the laws of the State of Mary-

and, in such cases made and provided, whenever in their judg-
ment the general good of the town and the condition of the
treasury shall justify such proceedings.

25. The year for repairing the streets, lanes, alleys and
thoroughfares of said town shall be reckoned from the first day
of May, inclusive, in one year, to the first day of May, exclusive,
in the next year. Every able-bodied male person between, the

age of twenty-one and fifty years who has resided in said town
for four months shall be bound to work on said streets, lanes,

alleys and thoroughfares for one day in every year, as the year
is herein defined, and if any person who is liable to render ser-
vice fails to attend on notice from the bailiff, or who appears

and fails or refuses to work and render services as by the person
or persons supervising the work he is required and instructed,

shall be guilty of a misdemeanor, and on conviction thereof be-
fore a Justice of the Peace or in the Circuit Court for Dorchester
County, such person shall be fined one dollar and shall be ad-
judged to pay the costs, and to stand committed to jail until fine
and costs are paid, and he shall be bound to render proper ser-
vices. Any person who pays to the bailiff the sum of one dollar
in lieu of rendering personal service on the streets, lanes," alleys

said thoroughfares of Vienna, shall receive a receipt therefor
from said bailiff, exempting him from work and service on the
streets for the term of one year, as the year is hereinbefore de-
fined, The Commissioners shall have power and authority to
pass one or more by-laws or ordinances for executing, carrying
out and enforcing the provisions hereof and providing system-
atic arrangements in respect thereto; provided, however, that
the said Commissioners shall be authorized to excuse and exempt
from the provisions of this Section any person who is physically
unable to perform the work herein required of him.

26. That the Commissioners of said town shall not expend
ner construct to expend, in any one year, more money than the
amount receivable by the Corporation from taxes and other
sources for that year.
