robin, dove, wild turkey, pheasant, ruffed grouse or ring necked
pheasant.

SEC. 39. And be it further enacted, That it shall be unlawful
for any person knowingly and unnecessarily to destroy or dis-
turb the eggs of any of the birds protected by the provisions
of the preceding Section.

SEC. 40. And be it further enacted, That any person or per-
sons violating either of the two preceding Sections, shall be
guilty of a misdemeanor, and on conviction thereof, be fined a
sum of not less than two dollars and not more than ten dollars
for each offence, with costs of prosecution; and all prosecutions
under said Sections shall be in the name of the State, before
any Justice of the Peace of said County; and all fines collected
hereunder shall be paid to the informer or informers or the per-
son or persons securing the conviction.

SEC. 41. And be it further enacted, That the possession by
any person within said County of any of the birds protected by
the three preceding Sections, shot, killed or otherwise destroyed,
shall be prima facie and sufficient evidence to make such person
liable for the fine for the violation of the provisions of said Sec-
tion; and it shall be the duty of all constables, police officers,
sheriffs, deputy sheriffs, chief game warden or deputy game
wardens of said County to arrest all persons they may detect
in or who may be charged with the violation of any said pro-
visions, and take them before any Justice of the Peace, of said
County, to be dealt with as directed by the preceding Section.

SEC. 42. And be it further enacted, That no person shall
shoot or in any manner catch, kill, trap, pursue, injure, hunt of
take in Harford County any rabbit, jack-rabbit, cotton-tail, part-
ridge, quail, woodcock, between December 10th and November
10th, exclusive of both dates, or upon any Sunday or election
day, or when the ground is sufficiently covered with snow to
track the rabbits or birds above mentioned; and no person shall
shoot, hunt, take, catch, kill, pursue or injure in Harford Coun-
ty any raccoon from December 1st to October 1st, inclusive of
both dates, or when the ground is covered with snow so as they
can be tracked; and the possession of any of the birds or game
mentioned in this Section, during the prohibited periods shall
be deemed prima facie evidence against the person having such
possession of a violation of this Section, except when it may ap-
pear that suck birds or game are for breeding purposes.
