said Article 72 to follow Section 94, and to be designated as
Sections 94-A, 94-B and 94-C, providing for resurveys of nat-
ural beds and bars by the Board of Shell Fish Commissioners
on their own initiative, and for review by the Courts of this
State of surveys or resurveys of natural beds and bars, and
for condemnation of the rights and interests of lessees of areas
within the limits of natural beds and. bars as established by
such resurveys or review by the Courts, and the oysters be-
longing to such lessees located thereon.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 83, 84, 89, 90, 93, 98, 103, 104, 105, 112-A
and 115-A of Article 72 of the Code of Public General La,ws,
as enacted by Chapter 711 of the Acts of 1906, entitled "An
Act to establish and promote the industry of Oyster Culture in
Maryland, to define and mark natural oyster beds, bars and
rocks lying under the waters of this State, to prescribe penal-
ties for the infringement of the provisions of this Act, and to
add new Sections to Article 72 of the Code of Public General
Laws to follow Section 82, and to be designated respectively as
Sections 83, 84, 85, 86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 97,
98, 99, 100, 101, 102, 103, 104, 105, 106, 107, 108, 109, 110,
111, 112, 113, 114, 115, 116, 117, 118 and 119," as amended
by Chapter 539 of the Acts of 1912, be and the same are hereby
repealed and re-enacted with amendments, so as to read as
follows:
SEC. 83. Any resident of Maryland shall have the right to
plant and cultivate oysters in the waters of this State; such right
shall be exercised in the manner prescribed in the following
Sections of this Act, and shall be subject to the regulations,
provisions and limitations hereinafter set forth, but no corpora-
tion or joint stock company shall be permitted to lease or take
up, or to acquire by assignment, or otherwise, any lands of the
State for oyster planting or cultivation. All natural beds or
bars shall be excluded from the operation of this Act, and no
person shall be permitted to plant or cultivate oysters there-
upon, or in any way to appropriate the same to his own use.
The term "natural beds or bars" wherever used in this Act
shall hereafter be construed to mean and include all oyster beds
and bars under any of the waters of this State whereon the
natural growth of oysters is of such abundance that the public
have successfully resorted to such beds or bars for a livelihood,
whether continuously or at intervals, during any oyster season
within five years prior to the time of filing of the application
