302 LAWS OF MARYLAND.

County School Commissioners of Dorchester County according
to their discretion and best judgment, provided that not more
than ten thousand dollars thereof shall be spent on schools for
colored pupils.

SEC. 4. And be it enacted, That the said the Board of County
School Commissioners, may in their discretion, appoint three
persons of good judgment, who must be residents of Dorchester
County, to serve as a Committee of Superintendence, to act as
the agent of the said School Commissioners in carrying out the
purposes and objects of this Act and with such duties as may
be prescribed by the said School Commissioners, the said mem-
bers of said Committee to be paid not more than $200 each for
their services; provided that the County Superintendent and
the School Commissioner representing the school district in
which is located the school building proposed to be repaired or
enlarged, or in which school district it is proposed to erect a
new school house, shall be ex officio members of said Committee,
with equal powers and rights as the other members of said Com-
mittee, but the said County Superintendent and the said local
School Commissioners shall serve without pay or any other com-
pensation than the official salaries which may now, or hereafter,
be paid to them, and provided that no member of said Commit-
tee, shall either directly or indirectly, be interested in a pecu-
niary way in any contract for repairing or enlarging an old
school building or constructing new ones and have no pecuniary
interest in procuring labor or furnishing materials for the same.
The County Superintendent shall be the Chairman of the said
Committee.

SEC. 5. And be it enacted, That the said Board of County
School Commissioners, or any Committee appointed by them
as hereinbefore provided, if the work of repairing or construct-
ing new school houses is put out on contract, shall require the
successful bidder, or the contractor to whom the work is
awarded, to make a contract in writing for the faithful per-
formance of his work, whenever the amount of the proposed
expenditure exceeds the sum of $500, and in the said contract
the said builder or contractor shall agree, as part of his contract,
to pay for all labor employed by him on such building and for
all materials used in the construction of the same, and shall give
bond for the faithful performance of the said contract, includ-
ing the payment of all labor and material, such bond to be ap-
proved by the said Commissioners or the said Committee, and
the said bond shall be given to the State of Maryland as obligee
