shall from time to time be due or earned by an employee, con-
tractor, or contractors, in the prosecution of said work or under
the employ of said town; also from time to time pass all neces-
sary orders for the payment of property purchased or con-
demned, and for material furnished, in pursuance of the pro-
visions of this Act; said Mayor and Common Council may, in its
discretion, employ a competent engineer to plan and superin-
tend the work of establishing and constructing the said system.

SEC. 4. And be it further enacted, That any contract or con-
tracts for the construction and installation of said System or
any portion thereof, shall be awarded by the said Mayor and
Common Council only after due advertisement of not less than
once a week for four sucoessive weeks in some newspaper pub-
lished in Prince George's County, the terms of- the proposal and
the manner of receiving bids and awarding the contract or con-
tracts to be in the discretion of the said Mayor and Common
Council, the person or persons to whom such contract or contracte
shall be awarded shall, if required, furnish a surety company
bond with penalty approved by the said Mayor and Common
Council and conditioned on the faithful performance of his or
their contracts, in accordance with the plans, specifications and
general stipulations under which the work is carried out.

SEC. 5. And be it further enacted, That the said Mayor and
Common Council of the Town of Mt. Rainier are hereby author-
ized and empowered to contract for and purchase, in fee simple, or
lease for a term of years renewable at their pleasure, and to use
and occupy the same, any land or real estate which they may
deem expedient and necessary for the purpose of establishing
and constructing, and in the maintenance of said system. If for
any cause the said Mayor and Common Council shall be unable to
agree with any owner or owners of real estate or leasehold
property, or for any right-of-way, or any other material which
partakes of or is a necessary part of realty, which they may find
necessary for the establishment and construction of said system
or if such owner is under any disability or incapacity to con-
tract, or is absent from the County, or unknown, the said Mayor
and Common Council of the said Town of Mt. Rainier are hereby
clothed with the power of condemnation, under the right of
eminent domain, as provided in Sections 360 to 366, in-
clusive, of Article 23 of the Code of Public General Laws of
Maryland, as fully as if said Sections had been herein incor-
porated, and the manner of procedure of condemnation for the
purposes of this Act shall be in all particulars the same as pro-
